Watched a whole lot of forensics files recently though and I can tell you if Dassey did any of the things he is convicted of doing there would be a wealth of DNA evidence to convict him.

And when appellate attorneys discover shit like this, especially when a defense attorney is actively colluding with police and prosecutors, they get people out of prison and taxpayers on the hook for millions in wrongful conviction compensation.

What scares me the most is the off-chance that Dassey actually had anything to do with this. Nirider is probably going to get that writ from the federal courts, and get a new trial. Then in the new trial that statement to O'Kelley gets tossed for sure, every statement Dassey made to police after retaining Kachinski gets tossed for sure, and in all likelihood the first four statements he made before his arrest. So now they have nothing with which to charge him. But even if the first four stand, they are going to get shredded because Dassey never volunteers information that is not first directly and overtly fed to him. Ever. Read every existing transcript (only the last interview before his arrest was videotaped and the first two were inaudibly recorded). There is not one single point at which Dassey volunteers a fact which supports the state's prosecution.

If they'd just done the job right, they might've actually found evidence connecting him to the crime (if he had actually been a participant). They might've gotten those "bleached jeans" (if they ever existed), or something else normally yielded from a properly diligent investigation. But they cut some pretty clear legal corners to make the thing easy and now the guy is going to get out, pure and simple. I only hope he is actually innocent.

No. That's not true. There is always doubt. You literally can't be 100% sure, because you weren't there right when it happened. You can only make a judgement based on the evidence presented. All of the evidence could be planted, none of it could be planted, video could be shopped, whatever. Because a case always deals with an event that happened(or didnt) in the past, you'll never be 100% sure. That's inherent to law.

And you do have to have evidence as the defense. The one who makes a statement has to provide evidence when it is disputed by the opposite party. It's called affirmanti incumbit probatio.
