Noir is crime fiction where the main thrust of the movie isnt about solving the mystery or beating up the bad guy, its navigating the shit of the world. Constantine the movie isnt noir because when he beats the badguy everything is shiny and happy goodtimes. Real noir is all about the tiny victories.
