Technically it is, the other Burger got double jeopardy wrong. DJ is being tried twice for the same crime without a injustice-derived retrial. The thought of someone getting their conviction upped or reinstated on appeal is unthinkable in the American justice system.
In the US, the prosecution gets one shot per crime. If they blow it at any point, it's over.
