PAY ATTENTION NOW: the cop's defense attorney did NOT say that Yanez fired because Castile pulled his weapon. If Castile had pulled his weapon you can be damn sure that this would have been the defense attorney's first statement to the press. But that didn't happen. The attorney said Yanez reacted to "the presence of the gun."
Defense is also not denying that Castile informed Yanez of his CCW and weapon.
In other words: Yanez saw a gun, after being informed there was a legal gun, and pissed himself.

It's quite possible that the officer, upon seeing the gun and panicking, ordered Castile to freeze and Castile put his hands in a "hands up" state, which is motion. That's a natural human reaction in a tense situation with cops. And officer training is quite frankly rather shitty here.

Castile was not "brandishing." He had just informed the officer of his CCW and weapon, LIKE HE IS SUPPOSED TO, and he never pulled the gun.

My theory of what happened fits the video we do have, the statements by the gf, and the statements by the defense attorney. Absent a major twist, this cop is guilty of manslaughter. Which is NOT MURDER, but does carry a prison sentence.

This is not nighttime or at a distance. Broad daylight, officer looking directly at Castile. He had a clear view of everything. He should have been able to distinguish between a man pulling and aiming a weapon, and a man simply putting up his open hands to show that he's not a threat, with plenty of time to react.
It does not matter that the order was to freeze. That does not absolve the officer here. (Though it might in a different situation: more distance, less light, etc.)
Note that his defense attorney claims he reacted to the "presence" of the gun. NOT that the believed the gun had been drawn. Which would be a nearly impossible claim given such a close viewing distance. Unless defense changes their story at trial, the implication is that the officer knew the gun had not been drawn and fired anyway out of fear. A knee jerk reaction if you will.
That's gross incompetence for a trained police officer. Manslaughter.
