Generally you always get dinged if you rear end someone because statistically if you're driving defensively you would not rear end someone. What you're describing is a rare outlier where a good driver would suffer, and insurance companies do acknowledge it happens but they won't care.
If you filled a road with trained defensive drivers you would notice in each lane the cars are always staggered to account for what you describe. You should never drive side-by-side with another driver, it's unsafe. Plus you should maintain the 2 to 3 car length rule even in opposing lanes.

On a awesome relaxed road trip to Yosemite with my wife. Were finally less than an hour from the park and the scenery is gorgeous, it's spring. I'm doing a few miles over the limit.
