I threw my dead cat off a huge train bridge after it was mauled by some guy and his dogs the night before and had gotten dead stiff. The RSPCA needed the body for the autopsy to procecute the man, after I got it they asked why I would throw a cat's body, one that I owned, off a bridge.

However if you want objective legal justification, think of it in terns of property laws/vandalism.
The human body is a piece of property. When a person is alive, the body is owned by the living person it contains. When that person dies, the body passes to the next of kin along with any other property that was not willed specifically.
Having sex with a dead body could be seen as vandalism/desecration of that family member's property, in the same way that having sex with their couch could be.
