This happens all the time. There actually is a law that makes flag-burning illegal, but the Supreme Court always rules against it because of the 1st amendment. If he has a half-way decent lawyer, he'll be fine.

Talking about laws, there's also laws that make gun owners have a license to carry, but the Supreme Court has ruled against that way back in the past because it violates the 2nd amendment. But now it seems courts just don't give a damn about the 2nd amendment anymore, so who knows.

Yes, conditionally. There are exceptions and exemptions, and not all local jurisdictions require that you be the actual owner.

For the most part, though, Yes. Burning someone else's flag opens you up to various complaints.

No. You have the right to use public property, within limits.

However, you do open yourself to various liabilities. Such as inciting a riot, reckless endangerment, other consequences of doing so in a reckless or otherwise irresponsible manner, etc.

Technically, you can stand in front of the Whitehouse gate, the entrance to a military installation, in front of a foreign embassy, or on the steps of Congress and burn a flag (any flag, not just an American flag) ... so long as you do so responsibly without endangering any people or property.

Now, pragmatically, you are very much subject to timing and luck as to who sees you, or takes a video of you, and what someone decides to do in reaction ... either private citizens or official law enforcement.

Example: if you quietly burn a small, notebook-page sized paper flag with a couple friends (maybe even in front of the Whitehouse gate) to take a quick video for social media protest, you may very well get away with that. Secret Service or DC cops might just decide to smile and stand quiet, no matter their personal feelings.

If you decide to take a car-sized plastic flag and flame it up with half a gallon of gasoline near a crowd of Trump supporters attending a Trump rally at the Lincoln or Vietnam Veteran's Memorials (national monuments, without permit) ... well, assuming they don't outright kill you, there would be legal ramifications for incitement to riot and generally endangering bystanders & property. The "intent" to initiate a riot could (probably will) get you, just as much as the "reckless endangerment."

tl;dr -- it's not a black & white issue. There is a gray scale that takes in many conditions & circumstances.
