I'll give an actual answer because I have a degree in this. So when you look at amendment cases you typically use strict scrutiny to determine if the law is constitutional. So when looking at the 2nd Amendment, it does not specify which weapons are protected, only that the people are allowed to "bear arms". Now comes the legal questions: what are "arms"? Is there a limit to what one can own? Does "arms" include nuclear weapons?

Now, there are a couple SCOTUS cases that have determined that specific weapons can be banned as long as those weapons aren't in "common use". These determinations are left up to the States. California is well within their rights to ban specific types of firearms as public safety has been determined to be a "compelling government interest" allowing states to enact these types of bans (SEE: Chicago, New York City handgun bans).

Where they REVIEW law made by the lawmakers to make sure they're not fucking up. If they deem the law to be unconstitutional, then the precedent is set and the law is reversed. If the lawmakers think the Courts are completely wrong, they can amend the Constitution, but this takes a SHITTON of time and effort.
