So when looking at the 2nd Amendment, it does not specify which weapons are protected, only that the people are allowed to "bear arms". Now comes the legal questions: what are "arms"? Is there a limit to what one can own? Does "arms" include nuclear weapons?
Now, there are a couple SCOTUS cases that have determined that specific weapons can be banned as long as those weapons aren't in "common use". These determinations are left up to the States. No, that would put too much power in the Court's hands (again checks and BALANCES). They don't belong to any party and they are appointed for life. The President suggests a nominee and the Senate approves or disapproves them. They can in your system because they tell you what the Constitution is and basically introduce laws. (For example the 'privacy-clausule' is for some reason enough to legalise abortion up to the 8th month). This is extremely unbalanced.
