This can't happen, can it?
>>
If you don't like it take it up the chain. Once you're under arrest the cops can't take it back even if they want to. 9/10 you're going to get let off because the PD won't even show to your hearing.
You fools trying to fight the system at the enforcement level crack me up every time
>>
>>79401614
Sure it can

>police approach you and say they're arresting you on some bullshit charge
>you know it's bullshit and talk back/instinctively pull back when they go to slap the cuffs on
>"Now we're adding resisting"
>cops have no evidence you committed original BS charge so it's dropped
>still get stuck with resisting what was always an unlawful arrest
>>
>>79401614
Of course it can.

Example:
>police suspects you of having marijuana
>you resist arrest
>they find out you didn't have marijuana
>you are charged by resisting the arrest

>resisting arrest

If you are stupid enough to do this, you get exactly what you deserve.

If they have no charges on you, then you can literally assrape the entire department with legal proceedings. Like literally, you can fuck every single person from the janitor to the police chief if you take it to court if you actually haven't done anything wrong.

You have to be a nigger to resist arrest.
>>
>>79401047
A charge is different from an arrest
You can be validly placed under arreat without being charged, ie released without charge
If you resist being placed under arrest, then you are commiting a seperate crime, which results in a seperate charge. So if the reason for the original arrest did nkt produce a charge, the only charge is for resisting the arrest.
>>
>>79402069
It's case law

http://www.srhunterlaw.com/Resisting-Arrest

>You would think that a person can only be charged with Resisting Arrest if the police have a legitimate reason to arrest them in the first place, but you would be wrong. A suspect commits the offense of resisting arrest when he resists any arrest by a known police officer, even where the arrest is unlawful. People v. Locken, 59 Ill.2d 459, 322 N.E. 2d 51 (1974).
>>
Why would you want to resist arrest if you've done nothing you braindead monkey?
>>
Don't resist Robert, Robert.
>>
Also smart police know how to hit you with a few more charges like:
>Assaulting a Police officer (inherent if you resist arrest)
>Offensive behaviour
>Disturbing the peace
>Offensive language
>Interfering in the course of justice
Etc.

Lots of peripheral charges implicit when someones resists arrest that you can hit them with
>>
>smoke some kush with another fella
>peacefully stroll amidst commieblocks
>a bunch of 5-0s come up to me
>hey comrade you smell like weed and your pupils are dilated (no fucking wonder, it was 10pm in winter)
>get taken to a police station in a police car
>my friend and I unintentionally make the car smell like weed
>cops are laughing at us and overall behave friendly
>they make us pass urine test, we fail it, they take our fingerprints from every finger on both hands and take mugshots
>spend a night at a police station
>next day they take me to court where I'd been sentenced to 5 days for "consumption of narcotic substance without a doctor prescription"
>where the fuck do I get a weed prescription in Russia?
>get taken to jail
>it's incredibly shitty inside, Latin American prisons tier
>food is shit
>populace is scary af
>everyone is smoking shitty cigarettes all the time
>police are rude af
>spent 5 days mostly reading La Reine Margot and Quiet Flows the Don
well I actually managed to get through it all without getting fucked in the ass so I guess I'm all good

Why are you arresting me if I've done nothing?
>>
>>79402464
In the US we have a problem with cops slapping "resisting arrest" onto nearly everything. It's so widely abused and common to the point where police yelling "stop resisting" as they're beating non-resisting citizens is a meme and popular media trope.

NPR even notes it here

http://www.npr.org/sections/thetwo-way/2015/01/29/382497080/arrested-for-resisting-arrest-yes-its-possible

>"Resisting arrest" charges may also be a way to lend legitimacy to controversial arrests. In the post-Ferguson protests, people reported cases of police loudly yelling "stop resisting" at people they arrested, even when no resistance was apparent.

Absolutely this

I used to hang out with a group of stoners and hippies in late 90s here in Norway

The police had records on all of them.

They stopped me a few times, alone and with friends, just to interrogate me and make me squeel.
I never resisted and I always told them as much as I had to. Just about myself. You are not obliged to know other people's business.

After 20+ years of being around criminal and drugs, I still got no criminal record.

Just don't be a nigger.

okay bud
>>
>>79402999
You forget the US is not Norway, where citizens actually have rights regarding police interaction.

If cops stop you and ask you about your criminal buddies, and you refuse to talk, that's obstruction of justice... and probably resisting arrest. Guilt by association is strong here.
>>

>make
Holy shit, that's harsh

I was at a music festival in Serbia a few years back and a cop pulled out a joint out of my friend's mouth, said he will write a ticket and take him to the station etcetera etcetera

My friend just slipped him a 50€ bill and the cop said "Sorry to disturb your free time, have a nice night"

Try doing that in Norway and you'll get lynched

You live under a totalitarian government and you are only free to do what they tell you.

>>79402293
You can be detained without any charges filed. It's usually so they can gather more evidence about the situation but once you are arrested the paperwork is involved
>>
>>79403241
If you associate with criminals you deserve whatever you get.

In America you can be detained under reasonable suspicion. If you start fucking with them during their investigation, you can be charged with "resist delay and or obstruction" which means you're fucking up their investigation.

I don't at all trust that them in general, what with all the HANDS UP DON'T SHOOT bullshit, but given how often police do this to everyone else I'm pretty sure they did it to some niggers in Ferguson too.

>>79403530
>And Americans are convinced they have freedom?

Only the dumb ones.

>I suggest moving outta there
To where? I'm a US, Canadian, and Greek citizen. Not sure where to go as everywhere is fucked.

The US is corrupt as fuck and a total joke. The longer I'm here the most I hate it. I swear the laziness and corruption is the only thing trickling down to every aspect of this country.

Canada is quickly turning into Feelings Land, what with the new "he's not smart but he's 'emotionally intelligent' PM. Still might be my best bet though.

The EU and Greece in particular is just a clusterfuck. Not even an option, really.
>>
>>79402340
This is insane.
>>
>>79403806
Yeah it doesn't take much to figure that out, I know.
But the corruption here isn't slipping someone 50€ and getting caught

Corruption here is formal, mostly on a piece of paper and you gotta pay a few million to get out
Legal corruption

also
why resist when you do not have anything they can take, unless they are up in your face?

Why you would resist arrest when you know the charge is fraudulent and could just take it up with the courts is beyond me.

Cooperation when you're getting arrested makes charges disappear
>>

Sounds exactly like the US, bro.

>be arrested for some bullshit
>police tell the media and your name is plastered all over the news forever
>lose your job, expelled from school, any significant other leaves you
>the government just keeps delaying your trial and trying to get you to accept a plea
>1-2 years later finally get a trial
>case is either dismissed or you're found not guilty
>name and alleged crime is still un-erasable and nobody will hire you or associate with you
>>
>>79403530
Usually things like that are just threats, though. They try and make you feel like you have no other choice and people usually just do whatever the cops tell them to.

The people here are dumb and don't know their rights and the cops are just smart enough to manipulate the fuck out of people. They teach the cops that people have to do what you want and that's why they have such giant fucking egos

Try Norway. I know it's Sweden-Tier, but even as a production worker you'll have enough to go around and even travel. The only difficult thing is getting here, but you're American, so I guess it's easy.

Norway has a quota of how many immigrants they have to take per year and I'm sure they'd rather take an American over a Sudanese niglet
>>
>>79402646
Wasn't sure if you had a 1st amendment right to swear, but it's a common "nothing" charge here.

It's an anti-degenerate offensive. Who swears at or around Police? Or if someone is swearing at the top of their lungs in public and shitting up the place, you can call the police and have them arrested.

First amendment has its downfalls m8, right to porn, obscenity etc. Overall a great thing, but stops you outlawing degeneracies.
>>
>>79403855
If you're just standing around playing on your phone and a cop trots up with cuffs in his hand saying "you're under arrest for trafficking narcotics" your instinct is to stick out your wrists and do as he says? Not even a moment of, "wait, what the fuck?"
>>
>>79402549
>Offensive behaviour
>Disturbing the peace
>Offensive language

This is why women shouldn't be in government
>>
>>79404327
We have plenty of laws outlawing degeneracy, but they target things that are actually harmful. Using a bad word when police are nearby is not degeneracy. If someone's running around in public raving like a lunatic like you've describe, that's a crime called disturbing the peace. Here in the US we (try to) outlaw the specific negative act, not certain aspects of it which may or not be harmful in themselves.
>>
>>79401909
But legally I'm not under arrest until there is a legal precedent to do so, and there isn't a precedent until there is evidence. I've been questioned by cops who thought I just broke into a house and all I had to do was play it chill until they realized they had the wrong guy. It isn't hard.

damn this is so spot on that I am actually amazed by the sims.

But you got one thing we don't got burger.
You got rights that are actually upheld, that is, when those rights have been violated you sue and you get handsomely rewarded for the injustice.

This is the only way you can prevent a state like ours, upheld the rights of citizens and not abuse them.

Here the story is dif, paper rights. The court is there only to punish you on behalf of the state. Suing is futile as you might ie have been crippled and get like 400k nok for that.

I have several cases against violations of my rights against the state right now. If this had happened over by you, I would have gotten compencation for these abuses. Here? Nah I'll get my driver license away, possibly losing my flat in the process too...

Fuck this shit man

Cops in the US are pretty shit. I called an ambulance out for my sick mother who had a really bad infection, and they decided to bring a cop with them for whatever reason. They came out, she refused to go to the hospital, and as she was walking to her room because she didn't want to be bothered by the ambulance people, the cop tased her and kicked her to the ground.

Keep in mind that my mom was 54 at the time, had several back surgeries before this, has heart problems, lung problems and weak bones from a hysterectomy and age.

Want to know the excuse he used to justify his actions? She lunged at her. A sickly old woman that was on death's door "lunged" at this trained, young police officer and he felt threatened enough to tase her and kick the shit out of her.

and I was there, she didn't fucking lunge at him.

This is why I hate cops. But also, I like it when it happens to niggers, because most of the time, they deserve it.

Friend of mine refused a car search becuase muh rights
>car was towed ($150+yard fee each day)
>he got booked, fingerprinted, thrown in the clink overnight
>paid $1500 to an attorney to fight the case
>lost a lot of sleep and had job trouble cuz jailed
>case was dropped by the prosecutor the night before trial

that was a "win" for muh rights
unless you're rich, you don't have any fucking rights.
>>
>>79402233
Why can't people understand this? Why do people have to act so indignant and mortified when being arrested?

You live in a civilized country; act civilly, cooperate and just get through it. If afterwards, you still feel it was unwarranted, then take appropriate action through legal means.

This is not fucking difficult
>>
>>79404949
Maybe because people, as human beings, naturally take offense to a 5'3" manlet with a god complex screaming at them like a child and trying to detain or search them for no reason other than said manlet needing to feed his thirst for authority and power over his peers.

Not saying all cops are like this, but holy fuck if it isn't a solid half of them.

If a cop comes up to me and professionally explains his suspicion and wants to detain me, so be it, he's doing his job.

However, if a cop walks up yelling and swearing like a 12 year old on Xbox live, cuffs already out, and orders me around like I've the scum of the earth who's already been convicted of whatever he thinks I did, I'm going to be pissed. Police, with the level of authority they have, have a duty to act like professionals, or at the very least decent human beings. For whatever reason it seems a large number of them purposely antagonize the public and act like douchebags to goad people into resisting or becoming hostile so they have more reason to fuck them over.
>>
>>79402233

Police can arrest you, period.

Happened to me. Arrested for drunk in public when I didn't touch a drop that night. Didn't let the pig fuck my shoulder up, so when I was breatholized at 0.0, it became resisting arrest and I spent the night in the tank.
Had to go to court a month later just for the judge to dismiss.
Power mustache cop was just mad I was stronger than him and was living it when I was in cuffs. Choked me, threatened with k-9,surrounded by 4 others. For walking away from a party. Done outsole just have shriveled dicks and can make you pay for it.

You're being memed on.

Here's how it actually goes down if you're not retarded:

Cop: hey, are you smoking weed?
Friend: no
Cop: hey, other guy. Is he smoking weed?
>shrug

Then the cop gives your friend a drug test, he fails, and gets arrested.

You only get arrested if you break into a run when the cop shows up, act like a dick, or outright lie. "I don't know" is never a lie unless you have awful friends that actively try to implicate you in their smoking.
