Read what they wrote none of it is a crime. Now if they wrote something along the lines of "Damn our attempts failed, I will have to be the next one to take the torch" or what have you, you would have them hook, line, sinker. But this is the equivalent of writing "I wish so & so would die" vs "I am going to". I'm sure it could be argued that you could write "I should do this, but I won't" or even just adding a JK to the end.
