Looks like we have an armchair lawyer on our hands. You probably aren't even aware of what New York Times Co. v. Sullivan is. I'll save you the google and tell you that it allows the media to publish literally anything it wants about public figures, even outright lies, so long as there was no "malice" behind the statement. Since it's next to impossible to prove intentional malice, it's very difficult to keep the media accountable for what it says about political candidates and officials, even if they are lying. A journalist can make up outright fabrications and then later claim they were simply misinformed or that they received their information from a source that they can no longer recall. So long as the journalist never admits that they intentionally lied, they are practically immune from civil punishment.

In theory this is intended to protect marginalized journalists who are presenting unpleasant but true information about a public figure, as was the case during the civil rights movement. In practice, it is now used to attack political figures (Obama, Clinton, Trump, Sanders, everyone) with blatant lies and distortions. The overall register of political discourse among editors and journalists has suffered an overall decrease, because they are no longer concerned about facts and balanced reporting, they care only about presenting a preordained narrative. Factual reporting has been shunned, replaced in favor of emotional reporting that deliberately attempts to coerce the reader.

For the sake of quality reporting in the media, some kind of legal reform needs to take place. The press is hardly free when it is impossible for fair reporters to be heard amid the sea of emotionally charged clickbait.

I agree but where do you draw the line about drawing the line?

That's exactly what we have now. The big corps are shameless government mouthpieces when it counts, just like the Iraq war and now on Syria.
