Most law is based around the idea that you are free to do what you want so long as it doesn't negatively affect other people. This is just basic empathy. I won't kill you because I don't want to be killed either. It is our common interest not do be murdered.
Fetuses aren't conscious. Therefore they can not be empathized with anymore than a plant. They have no common interest that needs to be protected. The idea that life does or doesn't have inherent value should have nothing to do with legislature because it is not the government's duty to regulate morality.
Murder isn't illegal because it's "wrong"; it's illegal because just about everyone doesn't want to be killed. Fetuses have no such desires. No one is truly being saved by outlawing abortion.

I would define being conscious as having qualities of a person beyond biological function, and to have these qualities be apparent to itself. More simply, to be able to think and have emotions and desires. A fetus is clearly not conscious during the first trimester because its brain isn't even fully formed yet. Contrarily a newborn clearly does have emotions and desires; it cries when it's scared and seeks comfort from its mother. Even if these qualities aren't always apparent from the outside as you were saying (nipple sucking poop makers), it is evident that these qualities exist to the newborn itself. Therefore, from the newborn's perspective, it is just as much a person as we are.
I think individual rights should be based off desire because desire is tangible. Our rights are based off our desire to have those rights and they are allowed because they don't conflict with more basic rights of others.
