The CDC statistics do not go by the legal definition of rape. They have their own definition, which inflates the numbers. The "incapacitated rape" statistic, as well as the other types of rape, are defined so loosely that the original point still stands, post-facto removal of consent could be a major factor in these statistics.
You original argument, "does rape culture exist", is false. It's punishable by law and is not promoted in society. Even if a self-reported statistic says 50% of women are raped.
The second link refutes your original 1-in-5 statement. 0.11% ≠ ~20%.
