Paterno was never accused of being involved in Sandusky's whole rape thing or anything of the sort. What happened is that the Freeh report accused him and other higher ups of covering up Sandusky's bullshit after it got reported, something that they're backtracking on since there's basically no evidence.
The only thing that Paterno actually got slapped with were NCAA things where the people in charge of college football shit basically gutted his career and life's work and invalidated all of records and such. The NCAA is not the law, has no due process, and is irrelevant outside of his own career.
Paterno is also dead, so invalidating everything good he had previously done for the community is nothing more than a giant "fuck you" to his family and punishing a dead man is rather pointless.
