"Seventh Circuit Judge Richard Posner sees “absolutely no value” in studying the U.S. Constitution because “eighteenth-century guys” couldn’t have possibly foreseen the culture and technology of today.
In a recent op-ed for Slate, Judge Posner, a senior lecturer at the University of Chicago Law School, argued that the original Constitution, the Bill of Rights, and the post–Civil War amendments “do not speak to today.”
“I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation (across the centuries — well, just a little more than two centuries, and of course less for many of the amendments),” he wrote. “Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century.”

Judge Posner, an outspoken opponent of late Justice Antonin Scalia, also blasted “absurd” posthumous encomia for the late conservative.
“I worry that law professors are too respectful of the Supreme Court, in part perhaps because they don’t want to spoil the chances of their students to obtain Supreme Court clerkships,” he wrote. “I think the Supreme Court is at a nadir. The justices are far too uniform in background, and I don’t think there are any real stars among them; the last real star, Robert Jackson, died more than 60 years ago. I regard the posthumous encomia for Scalia as absurd. Especially those of Harvard Law School Dean Martha Minow and Justice Elena Kagan.”

David Bernstein, who teaches at Antonin Scalia Law School, formerly George Mason University School of Law, called Judge Posner’s swipe at Scalia “revolting.”
“We all know Posner doesn’t think highly, to say the least, of Scalia. Judging from what Posner writes, the distaste seems to stem primarily from jealousy — Posner thinks he would be a far better Supreme Court Justice than Scalia was, and he resents that as a ‘lower court’ judge, his writings, though highly influential in their own right, will never get the same attention and accolades as Scalia,” Mr. Bernstein wrote."

Our Founding fathers wrote a lot more than just the constitution and it's pretty apparent from their body of work apparent that they considered culture and tech and deemed them important enough that thry exist upstream from any of our political machinations. Criminal courts in the US by vast majority deal with peasants being sent to prison for drug offences, motoring offences or domestic violence. Civil courts deal by vast majority with financial disputes, personal injury claims and bankruptcies.

A gaggle of 18th century landlords waffling on paper is of no functional relevance to the vast majority of US judges.

That Judge serves on the Seventh Circuit court to hear legal challenges based directly on the Constitution. When he is appointed to that office, he must take an oath to uphold the Constitution. The Court he sits on was formed by Congress in accordance with the Constitution. He claims, from his bench created by the Constitution, where he rules on subject matter of the Constitution, after taking an oath to uphold the Constitution, that the Constitution has no value.

This is a radical who wants to impose his will on the people. He does not believe in the consent of the governed.

He does. The vast, vast majority of US judges are not. Judges in criminal courts sit there all day processing peasants. Judges in US family courts sit there all day processing bickering peasants or their children. Judges in US civil courts sit there all day processing peasants.

The justice system in the US is by vast majority a rubber stamping process. The US constitution is a distant irrelevance to the vast majority of its function. The constitutional issues that are discussed in the circuit and supreme court are a noisy, narrow footprint distraction from the normal work of the courts.

It's to keep the police from actively trying to invade everyone's privacy unless there's a reason to do so. When police suspect something with good reason, there are judges on call 24/7 to approve warrants for them.

The majority of cases never invoke the USC. It's rare that sunshine isn't given a fair trial to the degree that the court needs to be involved same with unfair punishment. Most of the stupid shit judges have to do like minimum sentencing are put in place by the Feds.
