If someone crops a small part of your copyrighted work and makes very small alterations, is it still copyright infringement?

Short answer: Most likely, yes. In the instance you've shown, yes.

Longer answer: It really depends. There, of course, are exceptions to using copyrighted material in certain circumstances, such as for analysis/discussion, or for creating further art, etc. It all depends on what you're doing, why you're doing it, how you're doing it, and what, exactly, was copyrighted in the original material. 99.9% of the time, my advice is not to fuck around with copyrighted material, especially if you're using it in any even remotely commercial way.

That's actually a unique, outlier sort of case, with some complex legal issues. Probably too complex to address adequately here. In a nutshell, that artist was sued a few years ago for similar (though admittedly different) works, where he had incorporated photographs by another artist in larger newer works. In that case, some of the appropriations were ruled to fall within the fair use doctrine. Others weren't. Unfortunately, the case ended up settling, so we don't know definitively what the ultimate legal result would've been.

In the Instagram case, there have been no published legal opinions by judges in cases, so we can't really say definitively whether or not it fell within the fair use doctrine. The situation was poorly reported by the news media (as most legal issues are). Two issues come to mind: First, he didn't just print and sell the Instagram photos themselves. Rather, he added comments under them, in the style of Instagram comments, which were commentary on the photos. Second, there are complex legal questions about copyright for images posted on Instagram. That question really hasn't been addressed definitively, and it would be necessary to be able to move on to the question of whether his works were covered under the fair use doctrine.

ikr, I don't know how young sampling artists can cope knowing that even if they get lucky enough to make a hit they'll get sued for millions of dollars
