the beauty of sampling is that you can flip even the most played out piece of music into something new

You shouldn't worry about the legality of it. For one, you'll probably never be well-known enough for it to matter. If you are, you can retroactively get sample clearance or take down infringing works if it actually becomes a problem.
I used to worry about this but then I realized all the cool artists who used sampling never worried about clearance. Just use anything that sounds cool.

Like i saw a guy on soundcloud take a loop out of a Tycho track and didn't do shit to the sample, and then threw a beat on top that sounded like the beat for the original song, it was so dumb.
