I firmly beleive that we should make it clear that if you have sex with anyone that was not born as whatever gender they identify as, and is not the opposite sex aka hetero sex (unless you are a woman) that you are likely to spread AIDS and should not be donating.
The problem with "Men who have sex with Men" (official classification) donating blood is that the main way to have sex like that is anally, which carries a significantly higher risk of transmitting HIV compared to penis-in-vagina sex.
I think a better question would be "Have you had anal sex in the past?", which would be both more accurate in what they're trying to avoid and also more inclusive. Though some puritans may not like that that question is so candid about sex.

Easy: "men" in "msm" is based around physical sex. It's not really a dilemma if you understand that - someone can say they were never a man, never male, but if they think that applies to their sex then the statement is paradoxical. But as it turns out, screen people/blood for HIV is time-consuming, expensive, and carries the pretty significant risk of false negatives getting through.
