You can get a 37mm flare launcher without any real difficulty, but a 40mm grenade launcher is an NFA item that requires the $200 tax stamp and months of waiting for them to sort out your paperwork. It's because 37mm is a standard size for flares and smoke rounds for signalling. There exist 37mm antipersonnel rounds, like buckshot or whatever, but to my understanding, using them turns your flare launcher into an NFA item.
