>Firearm owners have no constitutional right to carry a concealed gun in public, a divided U.S. appeals court in California ruled on Thursday, upholding the right of officials to only grant permits to those facing a specific danger.

>The decision by the 9th U.S. Circuit Court of Appeals, a victory for gun control advocates which sets a legal precedent in western states, was seen as unlikely to be reviewed by the U.S. Supreme Court in the near future.

>The San Francisco-based court, in a 7-4 decision, found California's San Diego and Yolo counties did not violate the Second Amendment of the U.S. Constitution, which protects the right to bear arms, when they denied some applicants a concealed firearm license.

>"We hold that the Second Amendment does not protect, in any degree, the carrying of concealed firearms by members of the general public," Judge William Fletcher wrote in a 52-page opinion.

>Sheriffs in the two California counties had limited their permits to applicants showing "good cause" to be armed, such as documented threats or working in a wide range of risky occupations.

>The ruling places the 9th Circuit Court in line with other U.S. appellate courts that have upheld the right of officials in the states of New York, Maryland and New Jersey to deny concealed carry applications in certain cases.

>The U.S. Supreme Court in 2013, in the middle of a raging national debate on guns, declined to weigh in on whether firearm owners have a constitutional right to carry concealed guns.
Fuck any mod who moves this off the board

Assuming Trump's shortlist of potential SCOTUS judges isn't a lie, and I don't really have any particular reason to believe it is (SCOTUS picks are a great sop for the conservative wing of the republican party, since they give them what they want without really affecting his agenda) Trump is going to be far and away the best pick. Merrick Garland isn't pro-gun, he's a "moderate," and Hillary's choices are going to be a disaster.

I also believe that if we get a republican majority, he won't veto any pro-gun legislation that has a decent chance of getting on his desk. Gun Owners might be one of the most vocal and persistent sections of the voting public, but we're also basically the easiest to please, because literally doing and saying nothing gets you on our good side.
>>
>>30236145

>>
>>30236145

>>
>>30236263
It doesn't make sense, as gun owners we're all in the same boat. And it is sinking, and it is going to sink real fucking fast Hillary gets elected.
>>
>>30236059

Calfag here.

I am so ashamed to be living in this state right now.
>>
>>30236772
Well, originally the decision was no, fuck you San Diego, if they apply, and complete the requisite training give them permits. Then Harris(AGs are appointed, not elected)appealed the decision until the ninth judges that share her political beliefs, could affect the decision, and here we are. Or at least that's my understanding of the situation. I do remember some thing that happened a while ago was supposed to render California and every other state west of the rockies shall issue. I think this is the same case. So basically the dems get BTFO then threw tantrums until people got tired of dealing with them and just gave up.
>>
>>30236807
An attorney general from San Francisco.
A court based in San Francisco upholding gun control laws proposed and approved by San Franciscan Democrats, then signed into law by a San Franciscan governor.

Though to be fair, Moonbeam isn't as retarded to the same degree as San Franciscan liberals.

Anyhow, practically 99% of everything that is wrong with CA comes from San Francisco.

>>
>>30237016
Are you fucking kidding me.

The only reason heller was decided favorably, the only reason owning guns is still a right in this country, is literally due to the fact that a Republican was president from 2000-2008.

I don't care how edgy and anti-Republican you are. Any vote not cast for an R helps put a dem in the white house, which helps stock the supreme court with anti-gunners, which helps negate the 2a.
>>
>>30237016
This won't work because Republican voters are, by and large, dumb as fuck and will vote for literally anything with the (R) next to their name, even though if you ask them, they will agree more closely with Libertarian principles than whatever the fuck the GOP calls its principles these days.

This whole CC situation is the fault of the Republicans, not the Democrats. The Democrats are just following their nature. If a bird shits on your car, you don't get mad at the bird, you just don't park under a tree. If the Republicans had stayed true to the idea of individual liberty instead of pursuing a radical evangelical agenda, we wouldn't be talking about a dying GOP led by an orange buffoon.

Think this through logically:

The point of the second amendment is to allow the people to protect themselves from the government.

It doesn't fucking matter who you install in the government. As soon as they are elected, they _become_ the government and an armed populace becomes an exigent threat to them.

>>30242083
only in district 9, assuming individual states decide to take this as precedent and move to legislation
>>
>>30242117
Isn't there any actions being taken right now to get rid of this sudden infringement!?
>>
>>30242083
No, it means that Cali may make it illegal. At least, until it gets overturned. The 9th circuit is seriously a joke. Still cause for concern though, especially if the people don't respond.

>THE SUPREME COURT IS ON THE LINE YOU NIGGERS DECADES OF ANTI GUN JUSTICES WILL FUCK OUR RIGHTS TO BRITFAG OR AUSFAG LEVELS

What this really tells me is that the SCOTUS has too much power. The ability to rewrite law at a whim is not a power that should exist in the US.

Also, his statement as he made it was explicitly racist. If you can't accept this then we have nothing further to discuss because we are clearly operating in different realities.
Not really the reason I hate him though. It's mostly that I'm a bit of a budget hawk and his proposals put us about another 15-20 trillion in the hole over the next 10 years.

While I have plans, mister ATF agent, I haven't yet formed a militia and being from out of district, it'd be something like an act of war, probably terrorism if we were to mobilize in the first place. So no, nothing being done over here.

And it isn't sudden infringement, treason's been rife through every level of government, state and federal, for decades.

some of the earliest firearms laws were conduct laws stating how you can conduct yourself with firearms. These included such laws as:

>property owners banning guns
>entire towns banning concealed and open carry
>where you can bring a gun

There is this myth that in the 1800's it was the Wild West everywhere with everyone carrying a pepper box or slinging a musket or rifle. It simply isn't true.

In fact this argument has been happening since the second amendment was created. The English common law idea of the right to self preservation (needed for the outdoorsmen and woodsmen of Pennsylvania) vs the inner city "Quakers" of philly who wanted nothing to do with guns.

There is no right to constitutional carry in the second amendment, but a state can certainly grant it, this is a local issue, not a federal one.

Read the entire document.

A well regulated militia, being necessary for the security of a free state, the right of the people to keep and bear arms shall not be infringed

>well regulated militia

That means that if a militia was ever needed (or a draft)

>necessary for the security of a free state

Meaning that every citizen would be expected to join a militia if needed, after all it would be necessary for the security of America

>the right of the people

No right is unlimited, but no law can fully ban guns.

>to keep and bear arms

Meaning common military style weapons. This also means you are expected to keep (have) and bear (possess and train with) arms

>shall not be infringed

Congress shall not infringe, meaning have the effect of banning completely.

Nowhere does it say you can openly or conceal carry a pistol, it does say you can have it.

You fail to realize that the enumerated rights are the government recognizing the existant rights of the governed, not the government granting rights to the governed

Besides that the Millitia act of 1903 granst the status of militia to every able bodied male from the ages of 18 to 45

The court ruled only on the right to concealed carry. McDonald vs. Chicago established that carry out side the home IS a constitutional right and if concealed carry is not allowed, open carry becomes the defacto carry method. Unfortunately that means someone has to be busted for open carry and appeal their conviction through the courts. Expect the California judicial system to pull a New Jersey and drop cases that might make it up the appellate court ladder so they can keep an ban on carry in effect.

I don't mean to come off as a duck anon, but you're making it really difficult not to.
I disassembled the entire argument last time I came across this whole "2nd amendment doesn't mean what it says" argument.
Here is a link to a scan of an 18th century English dictionary.
I spent hours going through this previously defining all the words in the second amendment and the words used to define them.
In accordance with 18th century english.

The second amendment means that it is the inalienable right of the people of the United states of america to have, purchase, trade, sell, and own firearms of all types (context here extends to the trade ship verifying with Jefferson legality of owning cannons on civilian trade vessel)
It goes on to state that a well trained militia being civilian entirely, not regulated by the state or government shall not be restricted or infringed upon.
And it then reinforces that these rights cannot be fucked with.

I don't think people NEED tanks or AT4-HEAT or C4 but it is legal under constitutional law.
And I love me the constitution and the provisions it provides me and other americans.
If you want sit changed, get an amendment made. We did it before and we can do it again if it is truly necessary.
Go ahead and read up in that dictionary and translate it yourself

He's actually doing pretty damn good in polls for a 3rd party candidate but not enough to beat Trump or Hillary. Best we could really hope for right now is him getting more than 5% of the popular vote setting the stage for an "official" 3rd party with the ability to actually compete.

Problem is fuckheads like >>30244496 will never ever let it happen. The constant excuses against third party voting are why we don't have a major 3rd party. "But you're throwing away you vote!" >militia
https://www.law.cornell.edu/uscode/text/10/311
Literally every able bodied male 17-45, even non-citizens who have declared intent to gain citizenship. To be well regulated as unorganized militia is to have a suitably modern weapon, ammo for it, practice/train with it, keep it in good working order, and be able to respond when needed. Anti-gunners are almost universally not "well regulated" as militiamen.

>security of a free state
All enemies foreign and domestic ring any bells? A tyrannical government is by default the enemy of a free state, as are foreign invaders. A massive militia is a serious deterant to invasion and tyranny (when the tyrants are not insane already).

>not unlimited
"the right of the people to keep and bear arms shall not be infringed"
The statement is sealed as not to be infringed upon and without limitation for the people beyond "arms". The right is effectively unlimited pertaining to the ownership and carry/possession of "arms".

>military style
No, it means if it qualifies under "arms" we can have it. There's no military "style" about it. If they can have it we're supposed to be able to as well. As for the rest of that go back to the top of this post.

>not infringed means can't completely ban
https://en.wiktionary.org/wiki/infringe#English
http://www.merriam-webster.com/dictionary/infringe
http://www.dictionary.com/browse/infringe

You're not even supposed to mess with it even a little. Basically anything that frustrates or prevents our right to keep and bear "arms" is flat out infringement and thus illegal as fuck. And no, arms does not mean the ones attached to your shoulders.
