McDonald vs. Chicago established that carry out side the home IS a constitutional right and if concealed carry is not allowed, open carry becomes the defacto carry method. Unfortunately that means someone has to be busted for open carry and appeal their conviction through the courts. It goes on to state that a well trained militia being civilian entirely, not regulated by the state or government shall not be restricted or infringed upon.
And it then reinforces that these rights cannot be fucked with.
