China's Fishing Ban Adds an Entanglement for Vietnam in South China Sea

Beijing injected an extra irritant into its long-running dispute with its neighbors with the South China Sea as it announced its annual ban on fishing in the area and vowed to stop vessels that drop a line into the contested waters.

China’s move brought a condemnation from Vietnamese fishermen on Monday, as their representative said the move is illegal and threatens their livelihood.

“They can apply the ban in their water, not in our water because that would violate our law,” said Nguyen Viet Thang, chairman of Vietnamese Fishery Association.

“We have said before that the ban does not have any validity to Vietnamese fishermen,” he told RFA’s Vietnamese Service.

South China Sea: 2 Chinese Fighters Conduct 'Unsafe' Intercept of US EP-3 Recon Aircraft

The incident could have violated existing bilateral procedures between the United States and China.

On Tuesday, in international airspace over the South China Sea, two Chinese fighter jets flew dangerously close to a U.S. EP-3 Aries signals reconnaissance aircraft. Lt. Col. Michelle Baldanza, a spokesperson for the U.S. Department of Defense, confirmed on Wednesday to NBC News that “two tactical aircraft from the People’s Republic of China” had attempted a dangerous intercept against the U.S. patrol aircraft, coming with 50 feet.

The two aircraft were reportedly J-11 fighters, some of which have been stationed on Woody Island in the Paracel Islands since November 2015. The incident is being further investigated by U.S. Pacific Command.

Contacts between Chinese and U.S. aerial assets in the South China Sea are common occurrences, with fixed procedures; this incident is notable precisely because the U.S. Defense Department is describing it as unsafe, suggesting that the Chinese pilots involved behaved unprofessionally.

Moreover, this isn’t the first unsafe intercept by Chinese fighters against U.S. surveillance aircraft. Similar incidents have taken place in August 2014 and September 2015, most recently. The August 2014 incident took place in international airspace off China’s Hainan Island, in the South China Sea, while the less serious September 2015 incident took place in airspace off the Shandong peninsula.

In 2001, a collision occurred between a U.S. EP-3 Aries and a Chinese fighter jet near Hainan Island. That incident resulted in the death of the Chinese pilot involved, damaged both aircraft, grounding the U.S. EP-3 on Hainan, and spiraled into a major diplomatic crisis.

To prevent a repeat of the Hainan incident, as the 2001 episode came to be known, the United States and China, in November 2014, adopted a memorandum to regulate the “safety of air and maritime encounters” between their militaries. In September 2015, the two countries added a supplement to strengthen the provisions of the joint memorandum.

It may turn out that the behavior of the Chinese pilots in Tuesday’s incident violated the procedures set out in the memorandum, potentially setting back trust between the two countries. So far, the Pentagon has outlined the scope of the incident generally, without assigning culpability. Baldanza’s written statement reportedly noted that “Over the past year, DoD has seen improvements in PRC actions, flying in a safe and professional manner.”

The incident also comes as regional states and the United States eagerly await the decision of the Hague-based Permanent Court of Arbitration on the merits of the Philippines’ case against China over its maritime claims in the South China Sea.

BEIJING, May 19 (Xinhua) -- China appreciates the support of the governments of Mozambique, Burundi and Slovenia on its stance on the South China Sea issue, Foreign Ministry spokesperson Hong Lei said Thursday.

The three governments back China's efforts to resolve territorial and maritime disputes with directly involved countries through consultation and negotiation, Hong said at a regular news briefing.

"Burundi calls for correct understanding of China's exclusion of compulsory procedures to resolve the disputes, while Slovenia fully supports China's position on international arbitration of the issue," the spokesperson said.

He said the three governments' positions "help safeguard international fairness and justice."

Some 40 countries have expressed support for China's stance as an international tribunal in The Hague is due to announce its decision in May or June for an arbitration case filed by the Philippines against China over maritime disputes.

China has refused to accept or participate in the arbitration. It declared in 2006 it would exclude compulsory arbitration on disputes concerning maritime delimitation, a right guaranteed under Article 298 of the UN Convention of the Law of the Sea.

China advocates a dual-track approach to solving the disputes. The directly concerned states should negotiate in line with international law as China and ASEAN countries work together to maintain regional peace and stability.

CHINA’S stance on the South China Sea is backed by many Arab countries, which expressed staunch support for Beijing’s efforts to settle the issue peacefully.

In a statement issued at the 7th Ministerial Meeting of China-Arab Cooperation Forum, the participating Arab countries said they supported China’s efforts to resolve territorial and maritime differences through friendly dialogue and negotiation.

They also stressed that the rights of sovereign nations as well as the UN Convention on the Law of the Sea signatories to choose how to solve their disputes should be respected.

China has widespread support in the international community for its decision not to have anything to do with a legal case lodged by the Philippines against Chinese claims in the South China Sea, a senior diplomat said on Thursday.

China has been stepping up its rhetoric ahead of a ruling expected in a few weeks by the Permanent Court of Arbitration in The Hague on the Philippines case.

China says it is fully within its rights not to participate in what it views as forced arbitration, and says the Philippines is using the case to directly undermine Chinese sovereignty.

In February, the United States and the European Union said China should respect the ruling. The court has no powers of enforcement and its rulings have been ignored before.

Xu Hong, head of the Chinese foreign ministry's Department of Treaties and Law, said the issue was being hyped up by people who lack a proper understanding of international law.

"We can see so many countries coming to the fore hyping this issue up, but it doesn't matter how loud their voices are, they still represent a minority of countries in the world," he told a news briefing.

"If you look at who is talking about international law all the time, it is politicians and non-professionals with ulterior motives. It is them who really need to learn something about international law."

During the incident, which took place Tuesday, the fighters reportedly came within 50 feet (15 meters) of the Navy plane.

Flying two supersonic fighter jets within 50 feet of a four-engine turboprop aircraft is dangerous, especially when the pilots cannot communicate effectively with each other, nor are the intentions of the intercepting aircraft clear.

One mistake, either in judgment or airmanship, could result in a lethal incident.

This is not theory -- it has happened in this same airspace with almost the identical participants. In April 2001, a Navy EP-3E was intercepted by a Chinese J-8 fighter.

The Chinese pilot misjudged the distance between his fighter and the Navy aircraft. He attempted to do a zoom climb from under the aircraft and pull up immediately in front of the cockpit. He clipped the aircraft, lost control and crashed, resulting in his death.

The EP-3E was severely damaged and was saved only by the skill of the flight crew.

Unfortunately, the crippled plane made an emergency landing at a Chinese air base - thereby compromising the technical capabilities of the aircraft's electronic intelligence gathering capabilities.

She added that any unbiased country would support China.

Countries including Burundi, Slovenia, Niger and Mozambique had pledged their support for China, the Foreign Ministry said this week.

Real hostilities with China would probably cause an immediate tanking of the stock market, but there's still manufacturing in the U.S. and if we had to, we could ramp our manufacturing capacity back up. So, let's think this through for a moment.

China will be fighting in or near their home turf, and thus have the homefront advantage over us. We can most definitely win a protracted war, but their overwhelming numbers mean that we're going to take casualty figures that may not be acceptable domestically.

If the (hopefully hypothetical) showdown happens between China and the US, we're going to need all the help we can get from the nearby allies. That means flaky assholes like India and Pakistan, pissed off Muslims in the Oceania, and maybe coercing Myanmar into letting us hastily build an airbase or two in their borders. Europe has virtually no significant armed forces to speak of if we don't count *our* troops already stationed there, so at best they can provide some sorties and quick materiel support (thanks NATO).

Iran is going to demand a ton of concessions in exchange for not providing support to China. Turkey is going to have a field day and cuck us to the Red Sea and back like they did with Germany. Sauds and Qatar will try to backstab us like they always do, unless we give them enough to do less of the backstabbin' than usual.

That leaves S.Korea and Japan as the only reliable allies, unless North Korea decides to join in and tie up our forces there.

I mean, fuck. This probably means that if China doesn't stop this shit, we're going to have to start playing nice with Muslims if only to keep South Asia and Middle East from bleeding us dry. This is a really shitty situation for us right now. I hope if (or when) the showdown takes place, we're ready for it. Otherwise we might suffer a Pyrrhic Victory at most from the exchange.

Our strategy for fighting china is called "AirSea Battle". We won't be invading the mainland, just taking islands and annihilating all Chinese air and naval forces. The goal won't be total take over like in Iraq or Afghanistan but to just grind them down with bombing runs until they surrender.

We don't need foreign help to achieve this but it is possible that France and the UK would provide limited support as they are the only other nations besides US that are blue water capable.

The only real difficulty we would face in a war against China is how we manage the potentially catastrophic economic fallout.

Modern China has a 1st rate fighting force with cutting edge technology. Vietnam is using hand-me-down weapons given by other countries out of pity.

The Vietnamese have incredible will to defend their country but a new war with China would not go well. Their navy would be oil slicks and their bases would be demolished by air-strikes before they got anywhere near Chinese soil (except for that reef island but they'd never make it to boots on the sand).

The US broke the bank with the last decade or so of war, they can't afford to face a military that is on more or less equal terms. Fighting China would not be like fighting Afghanistan, it's a war that the US could actually lose.

The US hasn't fought a war that they could potentially lose since WWII and it's not going to happen over some water that has only secondary effects on US influence.

China knows all this which is why they're happy to play hard ball on the issue.

S.Korea isn't a reliable ally against China. They can't be because they need to be more friendly with China than N.Korea. So they'd sit out that fight.

China could squish them or support N.Korea to invade so they can't oppose China and they sure can't oppose the USA who have so many assets there.

They're stuck between bad choices so they'd just apologise to both sides and crawl under a blanket.

N.Korea would get hammered by USA so they'd provide only some sort of moral support. They can't send ships because they'd be sunk by USA subs they never saw. They can't send air because lol.
They can't send troops because there's no real land war here.

Expect a battalion of N.Korean air defence guards that probably defend a Chinese mess hall somewhere.
