If you have a stock on your lower then it is now under the law a rifle lower and "cannot" be put in a pistol configuration. If you want a shorter barrel get a new lower and dont instal a stock.

They have to prove intent of you to put your pistol upper on your rifle lower, if you have no pistol lower its constructive intent as there's nothing else you coupd put it on, if you have both lowers then you are good, in those cases they have to prove you intend to use the pistol upper on rifle lower and since they cant prove your intentions the court legally has to accept your statement of intent as truth.
