If the person is retreating then its hard to prove the threat was imminent. There's been instances when people have proven it (assailant was moving for cover, was in the middle of turning back towards them etc)
FYI: the grave bodily harm includes but is not limited to rape, attacking with a weapon, or any forcible felony.
If you are asking, why isn't it ok to shoot someone in the back (regardless of the law) i agree with you. If someone is stealing from you, shooting them seems a decent way to deal with that. If someone has threatened you with a weapon, responding to that threat with deadly force seems like it could be reasonable. But that ain't how the law works (at least not here).
