If you were arrested in california for having a loaded revolver (registered to you) in your car, what are the chances the court judge would serve you jail time?

It's a felony misdemeanor.
>>
>>30646962
Where was the weapon? Was it outside of the passenger area of the vehicle, like in the trunk? Or was it within reach of the driver?

Was the weapon otherwise disabled with a trigger lock, or entirely ready to fire?

What were the circumstances surrounding the stop?

Was the person found with the revolver a prohibited person? Do they have a criminal record? Any weapon related or violent convictions?

What county did the arrest occur in? Did the person in question resist arrest or go quietly?

You need to give us more information than what you have before anyone can be even remotely helpful.
>>

>a felony misdemeanor
wut
>>
>>30646994

It was at a public event. I was doing camping and they were inspecting the vehicle. I had forgot about the weapon because I keep it there all the time. I am a delivery driver. So I use it for protection. I live in Nevada and you can carry a gun in your car.

The gun was in the glove compartment. It was 6 shot revolver. I had no criminal record or convictions. It was registered in my name.

It was in San Bernandido. I pretty complied to everything the officers did. They let me back in the event after I was released that day in jail.
>>
>>30647028
You have a revolver registered in your name in the state of Nevada? A state that does not register weapons.
>>
It's just my court date is this month and I don't know if I should have an attorney represent me or show up myself.
>>
>>30647083

I still had the receipt and location of the store I purchased it from.

They already confiscated the gun. I'm never getting it back.
>>
>>30647092
Assuming that you aren't full of shit and trying to make really lame bait, you absolutely should have an attorney representing you.

At bare minimum you should consult with an attorney regarding your case. Preferably a California attorney with experience in dealing with gun related criminal charges.

>Absent aggravating circumstances, carrying a loaded firearm in a vehicle or on your person is a misdemeanor. If convicted of this offense, you face:

>informal (otherwise known as “summary”) probation with accompanying firearms prohibition, from one to three years
>up to one (1) year in a county jail, and/or
>a maximum $1,000 fine

>If you are convicted of carrying a firearm in a public place or in a vehicle under one of these subdivisions, you face the same misdemeanor penalties listed above OR possible felony charges.

>were previously convicted of a misdemeanor crime against a person or property, or of a narcotics or dangerous California drug crime law

OR

>are not listed as the registered owner of the loaded handgun with the California Department of Justice

>If you are convicted of this offense as a felony, you face:

>16 months, or two (2) or three (3) years in county jail
AND
>a fine of up to $1,000.

tl;dr the gun's not registered in CA, so it's entirely up to the prosecution whether you get buttfucked with a misdemeanor or felony charge
>>
A new criminal is reborn. Welcome to a life of drugs, violence, and misery because you left your gun in a car. If you have kids you might as well put them up for adoption.
>>
>>30647135

they can just change it to a felony like that?

holy shit. It's a high class misdemeanor but that's brutal.
>>
>>30647537

should I just go into hiding or some shit?

or will I just not be allowed in California?

Need more details. Did you give them consent to search the car? "Inspecting" sounds like a loophole to perform an illegal search.

Dude what
>>
>>30647661
It was a mandatory inspection for all the cars entering the campgrounds.
>>
>>30647911
Holy fuck what a trashcan of a state
>>
>>30646962
>not having it locked in a "safe" under your seat, glovebox, or arm rest compartment

however the law is iffy on it being loaded while in a "locked container"

A felony misdemeanor is a thing retard.
>>
>>30647135
>This taxpaying citizen will be a felon because he had a legally purchased gun in his vehicle during a camping trip
>California has "santuary" cities where illegal aliens can hide from deportation and prosecution for crimes
>California has a program that pays "repeat criminals"(niggers) $1000+ a month not to commit crimes

If Leftists actually wanted to do good in the world they would kill themselves enmasse.
>>
>>30647911
Since when the fuck is this a thing? They gonna search my truck if I want to camp at Calaveras Big Trees now?
>>
Do you guys think I would be alright just bringing in the documentation (4473) from the gun store and proving it is my gun?

I know it wasn't registered in CA but wtf, how can they make it a felony charge?
>>
>>30648221
How come it was registered in Nevada? Your story seems off.
>>

???

Is the repeat niggers thing real? I'm going to become a nigger criminal if that's the case.

Go to calguns.net, they have lawyers that specialize in 2a rights. I believe it's the 2a foundation that does it
>>
>>30648290
Yes, it was piloted in Richmond, CA, and it's how we're going to get gun crime under control so they don't come for our guns.

>niggers nig
>millions in court and incarceration costs
>feinstein's cunt face on TV every day whining about gun control in a fucking state that has stricter gun laws than france
>throw nigger some chump change so he has income while going to the tech and getting a job
>gun murders plummet
>everything went better from reception
>>
>>30648221
You are not a resident of CA and only visiting so I assume having an unregistered gun shouldn't apply to you and at the least have the prosecutor drop that charge.
>>
>>30648460

Right. I have the 4473 showing my information I filled out the moment I purchased the revolver from the gun store.

I know in Nevada it is not a problem to transport a loaded firearm. But I was unfamiliar with california laws and at the time I was arrested only did I find out you cannot do that.

This whole concept of needing to give in to extreme left "socially progressive" programs or else they're going to send their SJW Gestapo and take your civil rights disgusts me to no end.

>Pic fucking related.
>>
>>30648221
>Do you guys think I would be alright just bringing in the documentation (4473) from the gun store and proving it is my gun?

I've done several 4473's, but I've never been given a copy of one.

Are you supposed to? Is it something you can request?
>>
>>30648921
No, gun must be registered with California DOJ, anything else is meaningless.

Your best bet is probably to get a decent 2a lawyer and hope you can nope away with a fine and nogunz for a couple.or three years.

A felony misdemeanor is a thing in California, basically it means the same crime, based on prior or circumstances can be charged as either, judge's discresion. Technically, a crime of that category could be charged at felony level even without the "felony circumstances" being filled. All depends on how nofunz your judge is anon.
>>
>>30648893

Repeat criminals are unemployable, since no one wants to voluntarily take on the rizk of employing them and they can't go into business for themselves . If they have a guaranteed income instead of having to resort to organized and/or violent crime, those kinds of people will be less likely to commit homicides with firearms, lowering the statistics and causing there to be less demand for strict gun control measures. All in theory.
>>
>>30649005

so is it better for me to be there or not be there?

this isn't gonna end up as some bounty hunter shit is it?
>>
The "felony misdemeanor" is best described as a wobbler. This means that it could be charged as either by the court. Usually a felony is you have a prior record.

You should hire a lawyer that specializes in firearms cases! Contact the various pro-gun groups in California for a list of lawyers. You need a lawyer to defend you!
>>
Be there in court with a lawyer! You should go to court in person! That way you can communicate with your lawyer and the judge/court!

OP are you really so foolish as to come to /k/ for advise, not hire a lawyer and consider not going to court on the court date? (That has got to be one of the most idiotic things I have seen on this board!)
>>
>>30649118
Lawfag here.

It's always better for you to be there. Never skip out on your court date unless you plan on going full fugitive-mode and leaving the country. The judge will always treat and absentee defendant more harshly than one who appears before him.
>>
>>30646962
be sure to come back with an update
>>
>>30650687

Thanks guys. And hopefully by the grace of God, I will come back and give a recap for those interested.

I think I will go in person then as the lawfag said, but I'm scared honestly. My gf is coming with me and the last thing I want is for them to just lock my ass up in some other state away from home.. for this.
>>
>>30650740

I found a few lawyers (which could represent me because it's a misdemeanor, but it will help with me being there too) and some are not actually 2a lawyers but they are affordable and seem to understand my concerns. I hope the judge isn't literally Satan.
>>
>>30650740
Best of luck brother. Godspeed in this shit state
>>
>>30647911
I'm beginning to catch a strong reek of bullshit. Your story is beginning to show some thin spots.

What was this public event of which you speak? Public or private campground? What agency was doing the "inspection"?
>>
>>30650740
>>30650766
Good luck. As far as counties go, San Bernardino is one of the least socialist weasel infested counties in this god forsaken shit hole.

Never make the mistake of visiting here, there is literally nothing worth being here. I'm leaving the state for law school in a couple weeks and I won't be returning. Fuck California, fuck liberals, and fuck their draconian laws, fuck their love of taxing everything as much as they can get away with, fuck the high cost of living, and failed social policies which bankrupt states.
>>
>>30648941
Iirc, you have 30 days after arrival in-state to register with DOJ.
>>
>>30649118
Don't dodge out of any court appearances. You'll get a bench warrant put on your ass, then when you get pulled over for a broken taillight in 10 years the warrant pops up and you get extradited to California.

Comments for If you were arrested in California
OP, I am not a lawyer but I do understand and have a somewhat advanced knowledge of California Gun Laws. I hope this information will be of use to you and/or your lawyer.
The only official firearms registration in California is for what the state deems “Assault Weapons.” The registration of firearms in California is de facto, which means the State Government keeps records of firearms sales. California has a Dealer Record Of Sale (DROS) form. Those are kept as the records for “registration.”
Having a copy of the documents that prove you legally purchased the revolver might be useful. I would have them available.
It is not illegal to bring a gun into California, provided that you own/legal posses it and it does not violate the controls of guns in California, i.e. Assault Weapons and magazine capacity limit of 10 rounds. Your revolver would violate none of this. You had it loaded and accessible in your car, thus arrested. Other than that it was perfectly legal to bring handgun into California and keep it loaded on private property such as hotel room or friend/relatives home. The friends/relative must consent to it being there. You must only notify The State if you have moved into California, staying with relatives or vacation for a couple weeks does not count.
California Penal Code Section 25610 may not be of particular help because your handgun was loaded in your car but maybe it might inspire you or your lawyer for your defense.
>>
>>30648375
Is this shit actually working though? There's been three shootings I can recall in my area in the last two years. All by gangbangers. That's it. No gun suicides. No discharges causing injury or death. No defensive uses by citizens.

Fuck man...leave it to Feinstein to subsidize criminal lifestyles on tax dollars.
