Usually, laws only describe how things are to be done, as finding out about it would be, as you said, a given.
I just find it funny that it's mentioned every time. That finding out part could have been left out and would therefore condemn the acts themselves.
But no, by keeping that parts, finding out seems to be an important part of those religious laws.
Maybe that's just historical legislative? Did laws from that time all include being found out?

You don't have a direct prohibition, but you do get an indirect one with the Niddah laws buried in Leviticus somewhere.
Women who have had their period are forbidden from sex until they take a certain kind of ritual bath. (and men are forbidden from having sex with such a woman) Unmarried women are forbidden from the mikveh, the bath in question, so can't reconsecrate themselves until they're wed.

"found out" in this case would be considered being convicted (you can't punish someone who commited murder unless they are found guilty), paying the fee is the punishment. Don't know how they viewed marriage completely though.
