Yes, especially if the mp3 has low bitrate. But you'll probably not notice it unless you have very high quality headphones.

Listening to a mp3 with something around 320kbps is pretty much the standard.
The difference isn't that discernible unless you have good equipment, and in which it won't be a day/night difference either. The whole thing is subjective anyway.
I, for one, could feel that the voice is slightly crisper and less muddy on wave files, but it could be placebo and my brain is forcing me to believe so (never done any blind tests anyway)

Maybe a stupid idea but: Why not use a sort of "I own the work" button ?
People press it if they have the work (bought or downloaded) and you display the number of people who own it (or a percentage of the userbase).
Then, the user can look at the number. If a lot of people have it, it's probably uploaded somewhere or someone might be able to upload it.
It doesn't solve everything but it seems better, rather than having just two states ("available" and "unavailable").
