Am I fucked up now? My harddrives are encrypted. What should I do?

Why aren't you formatting your drives now? Fucking idiot. Just install Windows 7 and Ubuntu on them and download a bunch of shitty memes. Pirate a few dozen songs and a couple movies. I could do this in a hour. They'll apologize for wasting your time. If you do that and send them in it'll look great in court. So once again, wipe them, install normie shit, send them in.

>>55628987
The fuck you talkin about? It took 4 days to do a 35 pass wipe on 6x 2 TB drives. Even then, the gutmann is way overkill for modern drives. 13 pass is the absolute most you'd need, 1-3 pass is adequate.
>>
>>55628987
Yeah, your only option now is to send in a different HDD or SSD and physically destroy the platters on your current one. I recommend scratching the fuck out of them with a really sharp blade, using magnets if available, then shattering/breaking them up into small enough pieces that you can flush half of them down the shitter. Bury the other half along the wall of a large permanent structure that isn't your house.

This is why I use 200GB HDDs for storing sensitive information. They're cheap and I can format them all in minutes.

>>
>>55629400
>SSD can't be wiped?
You could wipe them by filling with random data. But it is not guaranteed deletion of all data. SSDs capacity is few percent higher then capacity accessible to user and this extra space is used for trim, wear leveling, etc. All this magic is dome inside the ssd controller. So user cant directly control which memory cells are overwritten.
Best solution to this problem is to use headerless or plain text encryption. Regular encryption with header is good too, just keep in mind that you will not be able to guarantee header deletion.
>>
>>55629074
Yeah the lawyer will sure know how to deal with your drive
>>
>>55629509
Very True, it's not impossible for SSD's to be wiped, although it is harder. The best way is to use manufacturer tools depending on the brand of your SSD, afterwards, wipe it normally.

Make another hidden encrypted partition, with something embarrassing, but legal. I suggest porn of really old people. When you are under duress, you can "break" and hand over that password, with a sobbing story of how you were attracted to your grandfather when you were a child.

Ok I'm not sure what mumbo jumbo the FBI uses but at the data recovery unit is the state PD they still use EnCase which is basically the same as photorec but has a lot of other useful functionality (which most molesters/CP hoarders get caught by). Most of the cases are not pedophilies though, but rather other criminals (web history, chat messages, other documents).

The recovery companies mostly fix mechanically broken hard drives then use similar programs for accidental formats. I think the department have contracted them at some point. I don't know of any case were data that has been wiped and overwritten more than twice has been recovered, even with hardware methods. If you know of one please refer to it.

Overwrite your data 7 times should be enough for the foreseeable future. Also don't fuck children and keep it to the 2D.

>>55630615
>Once again, faggot, prove that i knew it was evidence when i destroyed it.

When they serve you a warrant for the drive, it's fucking evidence, you idiot.

If you tamper with it in any way, they'll know, and they'll throw you in jail.
>>
>>55630635
So what?
If they prove something you won't be charged, no matter what you did.
>>
>>55629454
Dont know if troll or literally retarder
>>
>>55630662

You'll be charged with destruction of evidence and obstruction of justice.
You're almost guaranteeing yourself jail time, no matter what they think you did.
>>
>>55630655
And, AGAIN, faggot, prove at any point that i destroyed the drive AFTER i was told it was evidence.

It's not illegal to break your own stuff, kid.
>>
>>55630655
Depending on what he has on there, he might just be better off just pleading obstruction.
>>
>>55630680

There are various forensic drive tools than can prove it.

If you went before a judge and just told them "lol it was wiped", he'll throw your lying ass in the clink.
>>
>>55630673
No, nigger, I won't. that's not how the law works.

If I'm requested to bring in a hard drive as evidence I'm allowed to put it into microwave, as long as I bring in the remains it counts in court.

The cops don't have any more rights than I do, me and them contest in court to find me guilty or make them look like idiots and demand compensation.
>>
>>55630680
>It's not illegal to break your own stuff, kid.

It is when you've received a subpoena to hand it over as fucking evidence in a fucking criminal investigation, you fucking idiot.
>>
>>55630709
>Destroyed
As in physically stopped it from being able to produce any data at all.

In this letter situation, that doesn't even matter, because you have no way to prove, at all, that i read the letter BEFORE i destroyed the drive.

>whoops sorry guys i put my hard drives in the microwave every day before i open my mail
Too fucking bad for them
>>
>>55630717
>>If I'm requested to bring in a hard drive as evidence I'm allowed to put it into microwave, as long as I bring in the remains it counts in court.

Haha, oh lord, what the fuck dude?

You should really talk to an actual lawyer about this, you're clearly way over your head.
>>
>>55630728
Exactly what is evidence? The hard drive itself.
So as long as it's somewhat operational I'm free to do anything with it.

Files are not evidence, otherwise the files would be registered as such and requested.
>>
>>55630731

The fact police ordered you to produce those particular drives, and you had destroyed them either before or after you were served, is essentially an admission of guilt in many jurisdictions.

Destroying the drives will make your life much much harder, I assure you.
>>
>>55630728
Prove that i destroyed the hard drive AFTER i was given a subpoena.
>>
>>55630747
Actually I got away with more. Because my uncle is a lawyer and my parents know the judge personally. Then I sued the cops for antisemitism and discrimination and got the retard who investigated me fired.
>>
>>55630748

The hard drive is the evidence.

It's the same thing if the police ordered you to produce a company ledger in a fraud investigation, but you burned all the pages before handing it over.
If you hand over the ledger with scorched pages inside, the judge would fucking laugh at you while giving you a prison sentence for evidence tampering.
>>
>>55630761
>Prove that i destroyed the hard drive AFTER i was given a subpoena.

For the last time, IT DOESN'T FUCKING MATTER.

The cops want that drive, and you've destroyed it, that means you were trying to hide something on that drive, regardless of when they requested it as evidence.
>>
>post obvious made up story
>180+ replies

You are all tools
>>
>>55630779
The pages are the inherent part of the ledger. The files are not an inherent part of the drive.

It's like a request to bring in a basket, you just remove everything from the basket and bring the basket itself.
>>
>>55630757
No, it fucking is not.

If this was even remotely true, every single non-retarded business would be breaking the law when they sell off their old work machines and have the IT guys physically destroy the drives beforehand.

It's called being a responsible IT user and if i decide that i was to do this daily drive destruction before the pigs can get their hands on the drives, it's too fucking bad for them. It is NOT my responsibility to horde every single fucking object in my house on the off chance the police want it for some reason.
>>
>>55630796
>It's like a request to bring in a basket, you just remove everything from the basket and bring the basket itself.

Are you some kind of retard?
>>
>>55630798

Most IT staff don't destroy drives while their company is under criminal investigation, because THAT WOULD BE A CRIME.

The key factor is the active criminal investigation against this person, if the cops weren't looking into him, he could do whatever the fuck he wants with that drive, but now he knows the cops are looking into him, he's been fucking served already, destroying ANYTHING would constitute obstruction of justice at the very least, evidence tampering most likely.
>>
>>55630789
It DOES fucking matter dickhead, because looking suspicious is a very different thing to being charged with a crime. I don't give a shit the pigs think it suspicious that i thermite'd my hard drives only a day before i claimed to find out they wanted them for evidence, they do not have that data as evidence now nor do they have any legal ability to charge me with destroying it unless they want to give me free money when it's time for my counter-suit.

Open wi-fi and no drives means they have no ability to pin anything on me even if i walk into the room wearing an 'I LOVE MASHA' t-shirt.
>>
>>55630804
Believe me or not, that's exactly how it works in court. The cops can't do shit.

>your honor the files aren't there
>are you certain the files there were?
>no, that's why we requested the drive.
>as you can't see the files aren't there, so you have made a mistake
>b-but muh destruction of evidence
>>
>>55630796
>The pages are the inherent part of the ledger. The files are not an inherent part of the drive.

Ledgers hold pages, and the pages hold the information sought in a subpoena.
Hard drives hold files, and the files hold the information sought in a subpoena.

They're essentially the same fucking thing, hard drives and filesystems were designed as abstract versions of fucking file cabinets for fucks sake.
>>

Everyone would agree the story is likely bullshit.

More of an interesting discussion on how to wipe drives and what not.

I don't think many people here would help a legit criminal due to all the tinfoil and I highly doubt that a legit criminal would post here asking for help in the first place.

super easy OP, freeze your hard drive over night and keep it in a cooler until you get to the police office. when you walking up to hand it in fake trip really hard and smash the hard drive on the ground. 1)buy a new drive and copy all data from old to new.

If they just sent a letter asking for it, it is NOT legally evidence yet. Just blow it the fuck up. It doesn't matter how guilty it makes you look. You can't get in trouble for destroying evidence if they don't even have enough proof for a warrant.

They're literally just taking a shot in the dark and hoping it works. Just say no, thank you officers, and destroy your hard drives, just hit them with hammers. Get new drives for your own use and keep them clean. When the fuzz come with a warrant, you can give them what you are still using.

Without proof they can't do shit. At least in freedomland. Even if they prove you smashed the drives, you still won't have done anything wrong and they will be no closer to proving any felony.

Depends on the country and its key disclosure laws. In some places refusing to disclose the key is a crime in itself so you're fucked either way. In theory, in the "land of the free" you have the right not to incriminate yourself, but there already were some cases where the courts decided it didn't apply because fuck you, that's why.
>>
>>55629151
>You really think photorec and the like is anywhere close to professional data forensics software?

>>
>>55631144

Literally not the same thing.

Subpoenas are served to provide evidence to the police they already know you have.
If OP got served, the police know he has the drive, they want to know what's on it.

In your analogy, the police might have a sample of blood from one of the 200 crime scenes, and would subpoena you for a DNA sample.
Or put another way, they know you've got security cameras set up at your house, the house that you lead your 200 victims to your kill dungeon, and subpoena you for the video tapes so they can link the victims to the scene.
>>
>>55631357
>In theory, in the "land of the free" you have the right not to incriminate yourself

5th Amendment doesn't apply with password requests, a judge can still compel you to provide it.
