Seriously, even microsoft now accepts this compatibility layers are necessary when you need support from third parties than otherwise they wouldn't support you, for example the ubuntu for windows thing and trying to run android apps on windows phone.

Think for a moment, the way to solve the problem is to nip it on the bud: supporting platform-agnostic APIs and support open and well documented formats. Competition is good for the customers, but the only moment when microsoft doesn't try to lock their users and tries to be compatible with the established standards is when they're losing hard in a market.

By strict definition, the kernel itself is 3rd party, since it's not made by FSF(or alternatively, all the GNU software is 3rd party, since it's not made by the linux foundation). Something important a lot of people doesn't get is that with closed platforms the owner of that platform needs to inject money constantly and make it succeed as fast as possible, but if the platform is open source, you have different parts of the platform being worked by a lot of different parties and it can potentially continue existing forever because the work can be continued by someone else even if the original developer stops working on it, helping in the process the new developer to not start from scratch. I assure you I'm quite sober. See pic related for an example of what I'm talking about. It's impossible under Mac OS because there, there's only ever a single menubar. Under Windows and most X-based environments each window usually has its own menubar.

Some WMs let you hide menubars on a per-window basis, but this feature only works with applications that use standard GTK+ or Qt menubars. Same goes for anything under Linux that does funny stuff with menus (like Ubuntu's Unity). It only works some of the time unless you're one of the very few people who only ever needs the software bundled with your distro.

Arguable. More customizable certainly, but in terms of functionality OS X and any Linux distro are toe to toe, with one edging the other out depending on your use case. OS X has the advantage of commercial apps without a compatibility layer (and can still run said compatibility layer if needed) while Linux is undisputedly better if you're doing a lot of back end or sysadmin type of work.
