Anyone else hopping on this bandwagon?
>>
You can't class action them unless you are in certain states. You waive your right to class action against them in the tos/EULA for windows
>>
If everyone does this they will go bankrupt.
It's over, MS is finished.
>>
Only works if your last name is Goldstein
>>

You can't sign a contract which denies you a right. That shit isn't even remotely binding
>>
>>55292902
You are right, I would almost bet there are some kind of arbitration agreement clauses on the EULA. I been googling the case and I can't find any proof that it happened other than the Seattle Time news story.

Can anyone find any other sources? The article smells fishy.
>>
No, I don't use windows

How could someone be considered to have agreed to the EULA when the upgrade was automatic and without their consent?
>>
>>55293181
automatic updates are on the EULA since Windows XP.
>>
>>55293026
Name another carrier that gives you free pizza and ice cream.

Why are you even here?

Tmobile gives out free shit every tuesday to anyone with a T-Mobile line. That includes medium pizzas and small frosties. Apparently, the gave out free tickets to Warcraft too.
>>
>>55292316
They tried to fuck my shit. Good thing I prevented their malicious installation of that botnet by means of simple internet searches and taking the appropriate action.
>>
>>55292316
eula is a thing

Well, when you overpay for a shit service, I suppose they can(you) afford to let you believe they're giving that to you "free".

ok

EULAs that try to take away user rights get struck down in courts constantly.

>>55293435
From what I have seen they tend to be the cheapest.
>>
>>55293807
That makes a ton of sense given that the entire point of EULAs are to do that.

The entire point of licencing for that matter is to take away user rights to do things with your software that you don't want them doing with your software.

Got any examples of such court cases? I'm not trying to stir shit or anything, I genuinely want to read about this
>>
I would, but I don't live in the land of """""""freedom"""""""
>>
>>55294544
They don't exist. All licenses take away from user freedom because that is their purpose.
>>
>>55292316
I don't even have a lawyer.
>>
>>55292316
this case is retarded, she didn't get her money from W10 update, she claimed Windows started to work slow after she rolled back. Judge didn't give a fuck about free upgrade
Fucking stupid.
>>
>>55293480
Waivers are by no means airtight and are often more a scare tactic than a legal precaution
>>
>>55294780
"You are not allowed to criticize this product" EULA conditions are tossed out constantly, as in most cases they are blatantly illegal.

When it comes to class action prohibiting EULAs the only times they have been struck down as invalid is when they by extension make it unfeasible for the average person to join in federal antitrust suits.
