iCloud Music Library works this way: It checks your Library for songs in iTunes Music Store, if songs matches it puts it in a checklist, everything else gets uploaded (there are size and duration limits but it's the original file). You can decide to keep the download locally or to delete it locally but use the iCloud Library to Stream it. If you don't choose to delete it locally there's literally no problem.
I have a huge amount of remixes that's not on Apple Music and those files are still on my SSD as well.

I did a quick search but all I see is a letter from Jobs while being sued in Europe to open the DRM. Just like he tried to blame the owners for bad reception as "you're holding it wrong" he tried to blame others for Apple's choice to incorporate DRM as if iTunes was not the largest digital distributor of music and even acknowledged that "90% of music is distributed DRM free." There doesn't seem to be any documentation prior to the suit.
