>>
>>54274624
>refusal to decrypt is probable cause
>refusing to incriminate oneself is probable cause for considering criminal charges

Let's just say, for the sake of argument, that he is a pedo, and his HDD contains pizza. You know what he's guilty of? Storing illegal images. What's he not done? He hasn't locked anyone in his basement for 7 months.

What's been done to him is already far more heinous than anything he's even suspected of.
>>
>>54274624
"probable cause" for what? To compel him to relinquish his 5th amendment right not to self incriminate? It doesn't work that way. None of this works that way.
>>
>>54274591
Actually the police were monitoring freenet and obtained a warrant to arrest him on suspicion of harboring cp. In addition his sister claims he has cp on his computer.

However they have legally detained him for too long. They were only supposed to detain him for a short period of time until they could prove him guilty with evidence or find out they have jack shit on him and let him go. Detaining a citizen of the US for a long tine without evidence to their accused crime is a violation of the US constitution.

Once he gets out he can sue the city for illegally detaining him.

I know almost nothing about US law or the constitution, but I thought that the fifth amendment protected against needing to give them your key, because it could be self-incriminating if you did. Isn't there precedent for this?

What's different in this case?

I thought the US wasn't like the UK, in which if you don't hand over your key, you will be imprisoned for a maximum of four years (iirc).
>>

Nigga fuck school. With just 1 million dollars you will never have to work in your life ever again. You can buy a nice 400k house + 2x50k cars and have ~$1,400 left to blow every months for 30 years straight. Maybe $400 will go toward bills/gas at worst every month, that will still leave you with ~$1,000 to blow every fucking month. If you're 50 years old like the old police officer you'll most likely be dead before you run out of money.

He isn't withholding any evidence. Nobody can prove he has cheese pizza on his hard drive.
>>
Literally the ONLY reason the courts are even attempting this is because they know that when it's a question of pedophiles, the public tends to behave extremely irrationally. This is the ONLY possible case where they have the power to try and pull this shit, if the person were accused of any other crime this wouldn't be tolerated for even a second.

The ironic part is that we give them that power when we subscribe to the view that pedos are evil irredeemable monsters that deserve no sympathy and no mental health resources allocated to them.

Fear and hatred are tools for the government to manipulate you into handing over more and more of your freedom.
>>
>>54275113
There is no irony. This has been gone over and over again for 250 years. If he is not allowing access to the encrypted files for privacy concerns then that is a fourth amendment issue.

The fifth only allows accused persons in court the right not not bear witness against themselves. AKA not taking the stand.
>>
>>54275171
>. Nobody can prove he has cheese pizza on his hard drive.

My only point was that the widespread view that pedophiles are non-human is what gives courts the power to pull this kind of shit.
>>
>>54273986
Suspect..

For all we know this guy could have probably seen some sensitive info, been a whistleblower or something. And the mainstream media wants to flag him as a pedo because of "MUH ENCRYPTION".

I fucking despise pedos, but encryption is the only way to maintain privacy and provides protection for journalists and others

If this guy was indeed a pedo, then there will be enough proof by simply correlating times, monitoring network traffic, and obtaining a supoena on the pedo site (thus getting the master key and decrypting all the traffic).

One is not guilty until proven in court.
>>
>>54275506
>is what gives courts the power to pull this kind of shit.

>investigators had decrypted a Mac Pro using a recovery key discovered on the iPhone 5S the authorities seized from his client's residence. He said no child pornography was found.
>The authorities want the suspect to decrypt two external drives discovered in the search.

they found nothing on his computer. a "expert" "guesses" there is porn on the external hard drives. they want him to hand over the pass code to "check" the external hard drives.

hes never been charged. so far they have nothing to charge him against. they have to let him go. the law is being abused. right now under that 1789 "law" they can virtually keep any detained indefinitely for almost any reason.
>>
Come out ere unah! Your computer won't save your mumu soul!
>>
>>54273986

Id like to see the US see encryption through the lense of 2nd and 5th amendments.

Fuck pedos but they are usually used by the authorities as a way to expand their authority. Then when they get law and precedent off of them they use it to abuse the rights of normal citizens.
>>
>>54274608

Notice how he can fight dumb ass. Way better then what he would get in the third world shit hole you live it.
>>
>>54274624

Whatever they have off freenet and his sister wasnt enough to charge him or they would already do so.

Probable cause ran out I say its been 7 months and they dont have a way into those drives. And even if a pedo gets defended no american should be forced to testify against themselves.
>>

> Thoughts?

>>
Warra Wirrin mob that's you mumu neras
>>
>>54275221
the only actually real "suspicion" they have is his sister saying she looked at the porn along with him at his house.

they don't actually have any ip addresses.

all they did was
>monitoring the online network Freenet
so they found a man that they assumed was him

they have zero shred of proof. even his computer that they were able to decrypt by using his password they found on his iphone 5s showed not a single ounce of proof.

i hate pedo's too but they have nothing. keeping him locked up indefinitely is inherently wrong when they have nothing to charge him against. are we really going to allow indefinite lockup based on nothing?

there investigation can be summed with this:
>a forensic examiner who testified that it was his "best guess" that child pornography was on the drives
>>
>>54275221
Then charge him with obstruction of justice or something and imprison him for that. Doesn't matter what he did or didn't do, keeping him imprisoned for this long without even charging him with anything is a fucking disgrace.

One of the biggest issues with the US legal system is that the authorities know they can get away with breaking the law, since it will take forever to prove they broke the law in court. They're holding this guy illegally because they hope he'll spill the beans before his lawyer manages to get him released.
>>
>>54275051

The difference is some judges have order people to hand over security keys. Basically all this computer shit is new enough that it will be in flux until the supreme court ends up ruling on it.

paper receipts are typically issued by a machine which actually prints or burns ink onto a physical piece of paper

you can examine this paper and scientifically determine which exact machine issued this receipt

a fucking text file containing an IP is totally different and morphs from machine to machiene accross different states and mediums and a whole bunch of shit

it proves nothing

there is so much shit which has been used as invalid evidence for so long, this in itself is actually a crime.

they were in court against my uncle (mothers side) who was trying to claim a house that was apart of the families his and not owned by my grandfather. the reason why he had a case was because he had the same exact name as my grandfather and a similar signature.

No, we simply have slipped the fuck down from before and baby boomers allowed the government to use 9/11 as an excuse to create a police state.

There are still a few things that remain. Free speech in the US remains probably the freest while its one of the few first world countries where getting rid of guns isn't as easy as going "its <current year>."

The thing that is bizarre is that there are Americans who are ignorant of how low we have gotten in terms of personal and economic freedom since George W Bush, and how many Europeans notice this but are completely ignorant of how limited their speech has become. Or they have actually bought into the "hate speech =/= free speech" and "we're civilized, why need guns when we have cops? oh shit also need to ban knives now" narrative.

Western world is in trouble and all people are doing is going "lol amerifat" and "lol yuropoor." Meanwhile governments and corporations are just jerking each other off with only some mild resistance like Apple telling the FBI to fuck off.

What. You can't guess that sort of thing. Either you know it's on there, or you're talking out your ass.

He will probably be shunned from his community, won't be able to get a job or leave the country.

He's already sentenced to a life in a country wide jail.

You are right.

He can request his case be taken to a higher court and sue the city that imprisoned him illegally. I think he's waiting there in jail to maximise how much he will be able to sue. Smart man.

He will probably no longer be able to get a job but he'll get some good money from his case because muh habeas corpus. Hope he gets at least a million.

Nah they were just taking advantage of the "Internet is the wild west" bullshit. There were no regulations, so businesses and governments got in on the whole do whatever they want.

Now they have 9/11 and terrorism bogeyman to push all of the laws through they want. They're passing laws to gain as much power as they possibly can before there is blowback. It's too late now, the West is fucked.

I just don't understand why people are welcoming it through bullshit non-issues like feelings. Obviously this guy is likely a piece of shit but certainly they can't honestly think guy has to unencrypt his own stuff can they?

This is 100% the next thing they're going to ban btw. They're going to wage a war against encryption and of course they will win.

No, fuck off alphabet agencies.
>Hey guys, paedophilia is the worst, isn't it? We just want to get rid of encryption because paedophiles are bad.

This is pretty transparent. I'm normally not a conspiracy nut but seriously, this sure is convenient.

the amount of responses here that make light of the crimes almost certainly committed are either an indication most of you are only children or don't have children of your own or are simply lacking basic empathy.

the content is produced because there is demand. If there wasn't demand, no content would be produced. In the same way i partly blame the production of bad movies on the people who inevitably will go to see them, so do i place part of the blame on the consumers of this disgusting form of entertainment.

it sickens me that so many of you make light of this but whatever. it's 4chan, what more can i expect.

the real issue in the tech sense here is that this is playing right into the people in power. This man has almost certainly (no reason to frame him) done something very illegal and something the public despises. As such, they won't care at all about him other than people who see the bigger issue, which is the precedent this gives for further cases and eventually moving down into other criminal territories. This empowers the people of the mindset 'nothing to hide' and there is very little that can be done to undo the sort of damage this precedent sets.

welp time to go to somewhere with real freedom - oh wait

Isn't the crime possession, not viewing?
>>
>>54280131
The crime is being able to save it, whether or not you are intending to do so. If you view it on a computer and that computer has the ability to right click and save as. You are committing a crime.
>>

He isn't withholding evidence you idiot. He's refusing to give the government easy access to his harddrive which they suspect may have evidence on it.

This is just one of those things that creates bad law because everyone wants the pedo to go down so they'll do anything to make it happen. In reality, all he's doing is nothing and that makes it hard for the government which they don't like.
>>
>>54280066
thats not how it works.
>>
>>54275829

If everything you say is true that's complete bullshit. The judge and prosecutor need to do 7 months in jail and then be subject to a civil lawsuit with all assets liened so that should the defendant win he can seize their homes, cars, etc.

I fucking hate pedos but god damn it you have to have some evidence. Abuse by judges and prosecutors is also against the law and can also completely devastate lives.

>inb4 if he has nothing to hide he should just decrypt the drive

There have been cases where prosecutors have pushed for pedo charges because of porn with legal adult actresses who "looked too young." If a prosecutor is after you they will twist anything they can.

>>
>>54273986
Now I want to encrypt my data. But I'll not do it because I'm too lazy and it is easier to save files in case of a failure happens with the hard drive unencrypted.

>XTS-AES 128-bits
Quantum computing cracks it in seconds.

>>54276601
>In Europe, this would probably happen to him too
In European countries, refusing to turn over encryption keys is anywhere between a misdemeanor and a felony with a punishment of up to 3 years in prison, not a sentence of up to life in prison without a trial.

>>54276996
>I-its the baby boomers, they're the ones responsible
Bullshit, it's the younger generation as well. I've seen a significant increase in statists who think the government knows what's best for people on the internet as time has gone on and I highly doubt it's old people who finally decided to use the internet.

>>54282510
Quantum computing does little against symmetric encryption unless you get fuckloads of plaintext/cyphertext pairs in which case you can weaken it to about half its key length, but good luck convincing the defendant to let you encrypt gigabytes of shit with their key to get those.
>>
>The other was a forensic examiner who testified that it was his "best guess" that child pornography was on the drives
>the crimes almost certainly committed
Is this how law in the US works? Cause I'm pretty sure there also needs to be, like, a trial to prove someone guilty. And evidence.
This isn't about whether downloading pizza is wrong (it is), this is about authorities disregarding basic constitutional rights and using pedos as a smoke screen, knowing that there will be faggots like you who don't give two fucks about a fair trial as long as someone screams "PEDO! HE'S A PEDO!"
