It's not exactly new. States will try to take any power they can get. Ultimately when they get too out of line the district courts or supreme court will slap them down.

Marijuana is not in the constitution, marijuana was made illegal by Congress and the President at the time. Congress proposed the controlled substances act and "Dick" Nixon signed it into law. Then Nixon put marijuana in schedule 1 which basically made it illegal for any average person to possess and distribute.
