I mean, it's even pretty dumb to flat out claim that using Javascript to see if someone is blocking ads is illegal when you can do something as simple as attempt to load a file named something that every adblocker will block and put some variable in there.

If the variable remains unset then it was blocked, if the variable becomes set then it wasn't blocked.
It's basically as simple as checking that your scripts have initialized properly.

But you don't know the user is blocking ads, what you know is that something failed to load.

You can't actually detect that the user is actively blocking the ads. It's possible that it failed to load through a network or DNS error but you are interpreting that as a blocking action.

There's also the aspect of the detection (usually) being of a passive nature.
It happens in browser without any communication back to the original site. They don't "know" you are blocking their ads, the site is just dynamically loading in a way where you see a message telling you to disable your adblocker so it cannot be spyware as it is not taking information and sending it away.

There are a few variations of adblock detection though and some might not fit this argument.

I think the best balance is letting users to block how much they ever want while allowing the counterparty to detect and anti-adblock how much they ever want. I don't think there should be any special privileges given to either party on this matter.
