not sure about america (most likely true) but it's certainly true in the UK and much of europe, not handing over encryption keys is an automatic criminal offense similarly to other laws where you're required to do something lest the penalty be worse than the crime you're supposed to have committed
in the uk, there's some legal speculation that even random noise on the drive can be construed as encrypted data (and failing to hand over encryption keys for this random noise being an offense), but this has never been tried in court
