Why is it legal for mircosoft to embed malware into their programs? I mean did suddenly people who create virus's and other forms of malicious software get a pass and become respectable members of the community?
I guess that would explain those ad's saying download this free tool.

because they literally tell you that they do
Installing windows 10 comes with giant warnings about the maleware, it's legal because everyone installing it has willingly done it. Maleware isn't illegal, spreading maleware to unwilling targets is.
