Yeah they can, for rooted android phones they can change the IMEI number to another phone that has a valid IMEI number. For IOS, jailbreaking a phone and "repairing" the IMEI can change it.

Can't jailbreak if the iPhone is activation locked. It's basically a brick until someone enters the correct iCloud login info.
