If you only watch new premieres ASAP then maybe BeyondHD is good for you since Framestor are a little bit faster than other groups. But if you want to watch anything a bit older that isn't a super-popular AAA release, BHD's not a good choice at all. Even Framestor encodes have poor retention there.

again, it's all about the encoding settings. an encode with one set of settings might not look the same as another with different settings, even if the bitrate ends up the same.
if we're talking about good internal groups here, they try to aim for transparency with the source. this is of course easy to do, just set the bitrate sky high and it will look good almost no matter what the other settings are. the hard part is getting a good result while keeping the file size low, and in your example one group might have done a better job than the other. but again, there might be differences in scenes you haven't compared yet.

H264 isn't free but it's significantly cheaper for a company to use. An additional patents pool is making h.265 very expensive, almost impossible for many companies to use. Although I suppose in europe and elsewhere with zero software patents they'll be able to use it freely.

Perhaps, but it's going to take a few more years. Otherwise's it's h.264 for the next 20 years while we wait for the h.265 patents to expire.
