So I've got a 970 and a 2500k (4.2ghz) and am noticing performance issues, most notably in fallout 4. I'm only getting like 40fps, but msi afterburner is reporting that only around 55% of the gpu is being utilised. this seems like a way too massive performance gap to be a CPU bottleneck, but what the fuck do I know. Any ideas?

That could be the audio driver issue I got. Crashed with a goddamn Fury X during character creation.
If you have a steam copy, make sure to opt into the Fallout 4 beta and download it. Fixed my crashes completely.

why do people ask this? not him but i torrented the game. i have a 970 and i5-4590 and playing on 1440p and fps is around 60-90 depending on the area. turn down godrays to low or turn it off completely. its nvidia's new thing that does nothing except tank fps on their older cards and AMD cards. also try turning down shadows to high, some people have noticed fps gains.
also im glad i torrented before buying. the game is a huge disappointment. maybe 4-5 years ago i would have liked it, but the industry has moved forward while they have not. there is no way this game should perform so poorly with how shitty the graphics look.

because with almost every release for the past few years there have been either (or both) a day 0 and a day 1 patch that usually gets skipped over in the torrent. There was an update last night fyi.
I think there was a game not too long ago where a bunch of people were bitching about some game breaking issue that got fixed immediately and it turns out all of those people torrented the game. I think it was far cry or something.
And finally the reason I ask is because I bought the game and have similar specs to that anon with 0 issues other than a little bit of frame drop.

40 fps is plenty. Human eyes max out at 60 (30 per eye) so you're getting almost 70 percent of max possible performance. The brain is awesome too and can inject frames to fill that last 30 percent if you focus on the game and nothing else. For this reason I suggest playing in a dark room at 40 fps and you'll hardly tell a difference from 60

OP, atleast you get over half the usage, My 970 is basically capped at 30% i cant use more than that unless i stress test the fucking card... cant even play any of my games. My cpu aint even reaching 100% its hitting 70% at the most.
I have a similar issue. Putting shadow distance to medium and god rays to low makes my framerate 60 fps all the time. I have yet to see it drop below 60 fps. It used to drop to 40-50 fps in the city. Shadow distance made the biggest difference for me. Everything else is set to ultra/max 1080p. I'm also playing in borderless windowed because the game stutters like crazy in fullscreen even at 60 fps.

It's both heavily CPU dependent and really shittily optimized for multithreading.
I'm on an i7 920, have my resource monitor up on my second screen. All 4 physical cores are maxed during the game but all 4 of the virtual cores are ~15-20% utilization.
This is unacceptable from a game released Q4 2015. If it cannot even fully utilize an 8 year old CPU but is heavily CPU dependent they should all be shitcanned.

was about a ~30% fps increase on some games. (wow/h1z1), and it overclocked runs cooler than my stock 920.

I have the same specs as you, I have disabled in-game vsync, turned on Nvidia Control Panels vsync (pic related).
I also run the game with no antialisaing or ambient occlusion (motion blur is disgusting I turned that shit off). I left anisotropic filtering on because it gives better textures in the background.
