Again, if the license doesn't meet the definition at http://opensource.org/osd then it's not an open source license. People saying that open source is the same as source available is just like people saying free software means it's available gratis.

"free" software doesn't allow you to change the license, but some "free" licenses allow you to change the license to other "free" licenses. Usually only those that give you even less rights. There's even crap like the GPL which is so cancerous that when a single line of GPL code is found in any project, they sue that project and force it to release the entire source code under the GPL.
