Either their were other circumstances at play in your mom's case (the kids said before hand they wanted to kill him or were in a gang therefore making it reasonable to believe his life was in danger, the victim was young, etc).
In a normal case like this where this dummy just witnessed a dude get punched there is no way you're convincing a jury that he should be fearing for his life or the life of dude getting punched unless this guy had brass knuckles or some shit.
The defendant always has the burden to prove that they feared for their life, its an affirmative defense. You don't just get the presumption that because hit you or someone else they were gonna kill you.
