This. Luthor didn't mix his blood with straight up Kryptonian, but with Ancient Kryptonian Deformity. He started with Zod's corpse, preformed genetic experimentation (from ancient Krypton), and mixed his blood with that.
The question remains though, if it was illegal, why did the ship's computer contain detailed do-it-yourself instructions for the procedure. The ship itself is ancient, so I suppose it could be from a time before the procedure was banned, but then why did the computer know about the ban, as well as the current state of the Kryptonian Science Council?

Sometimes the DNA of differing species is similar enough to produce viable offspring. Sometimes it is sterile, as is the case with mules. Other times the offspring can sire it's own offspring, as is the case with ligers.
So, while Lois is more closely related to brine shrimp (both are native to earth), Superman's DNA could be similar enough to human DNA to produce a perfectly healthy child.
