Marvel's entire history proves Civil War wrong. That's the problem. The pro-reg side might have the more sensible argument... if this was the real world. But it's not. It's a world where governments are obnoxious at best, outright evil at worst, and should not be trusted with managing the people who are actually trying to do the right thing. There's a reason most of the writers ended up writing pro-regs as Nazis; from the point of view of the Marvel Universe there is no way their side was the right one, so clearly they were the villains of the piece.

Apart from arresting Cap before the Registration Act was passed, which was illegal and implied a level of corruption among SHIELD and the government that Cap - who I believe about a month before that had discovered that the Red Skull was a senior government figure, disguised as a guy named "Dell Rusk".

I mean, the basic problem with the kind of government who wouldn't notice that the very right wing, faintly German-accented guy whose name is an anagram of "Red Skull" is actually the Red Skull, is that they're idiots and you clearly can't trust them with anything. When you get right down to it and right after the literal Red Skull has been in charge of large portions of the US, and people are being weird and making sex clones of Teutonic gods because why the fuck not amirite and it kind of feeds into the literal Nazi scientist cloning kids at your Initiative training camp and billionaires telling you to suck their dick and register, you probably wouldn't be convicted by any real court over resisting registration. Notably, Cap was killed before he could stand trial, but because of who he was he literally had to stand trial instead of just being dumped in the Negative Zone.

I mean sure, you could argue that the suspension of habeas corpus is all that stands between America and utopia, but that's the beauty of America. Even idiots are allowed to argue.
