With literally the sole exception of Two-Face, not even one of the Arkham Asylum regular inmates and prisoners would qualify for being put in a mental hospital or for the insanity plea.
All of the others are emotionally unbalanced and thus a danger to society due to their warped mental state, but this does not make them legally insane because ALL of them are fully aware that they are doing bad things and thus most are not insanity plea viable.
Even many depictions of Two-Face actually make him not viable for insanity pleas as it portrays his split personality inconsistently and more akin to extreme bipolar tendencies then actual disassociative identity disorder.
