Avengers was no longer SHIELD at that point. After Shield was dismantled and rebuilt, Tony ended up taking over leadership of Avengers itself. So Avengers' problems were no longer Fury's problems.
And the reason why Tony shouldn't have been the leader was already explained by his Psych evaluation; Compulsive behaviour, prone to self destructive tendencies, and textbook Narcissism. That all blown up in a big way once Pepper left him alone to stew in self pity.
