This one gets a bad rap, and I'm sick of it. it's not even that bad of a cliche..
Think of all the villains that applies to:
- Gladiators
- Wizards with hexes
- Carriers of the rage virus
- People trapped in closed time loops based around themselves killing their other selves
- assholes

There's a difference between a moral code and broken logic.
Spider-Man doesn't kill, or at least tried not to before around 2005. He never pulls the "bad as him" shit, he just doesn't do it and actively avoids resorting to it. Even when TNTGSD happened, he realized killing the Goblin wasn't bringing Gwen back.
Batman you can argue to so obsessive that if he killed, he would just keep doing it because that's how he is. And to be fair, the whole point he stopped killing was so the writers could make him a rogues gallery. It makes sense though, because it's stupid that he kills thugs but he keeps alive the likes of Joker, Bane, and Penguin.

There's no reason why the government hasn't sentenced these guys to the electric chair or why some rogue cop or angry guy with a gun hasn't done the deed himself.
