The New Avengers can't operate on US soil, but I think they can do solo superheroing in the US just fine except for Sunspot. I mean, Squirrel Girl still does all her solo stuff in the US just fine without anyone hassling her.

Because it is a Bendis book which isn't a street level hero. I like his action sequence sensibilities which always makes the fight issues of his team books readable, but they hover between eh and shit. You'd think a man who has been writing team stuff for near on a decade would be better at it, but nope.

I still am fond of his Avengers run. I got into Marvel via the Ultimate universe in 2000 but never read mainline Avengers til years later, so his run was the one I jumped in on because I was a huge USM fan and was all 'whoa, Bendis is on Avengers now? Cool!'
