The main problem is not if a super hero kills, it's that the government never tries to just execute criminals they clearly can't keep in jail. Like in your picture, why should he kill them? They're completely at his mercy so it's not self defense anymore, it's an execution. The only time this argument really actually matters is with batman because Gotham's well known to be so shitty that criminals can get off on anything because the system's so corrupt.

The only thing that even makes all this possible in the first place is the contrived writing that must be accepted for comics to continue as they are. In a real situation, ("realer" might be more accurate) there's no way Joker would escape so many times and kill so many people and not be either executed or placed in a more secure prison.

The more you widen your scope in comics, the more the logistics of everything breaks down because of its need for stagnancy. That's why individual characters should be looked at for what they are: mediums through which to tell a good story, rather than as a character with a satisfying story to tell on their own.

All that said, I also feel like there's no reason Batman should be expected to compromise his ideals to kill Joker. He's already dedicated his life to fighting crime in a completely ridiculous way where few citizens do. What else could be expected of him? The blame goes to Joker, then the local government, long before it ever goes to Batman.

Why do people even live in gotham? In the realworld you have white flight where affluent people move to places that aren't full of gangs, except gotham has a thriving population of rich socialites and super gangs. What the fuck?

Other parts of the world are considered at least somewhat normal, so if the people don't rally to get an execution sentence then you can reasonably assume it's something the public just doesn't want enough to make a difference.

Gotham is different because the whole system is corrupt and basically any official can be bribed without a second thought. So there's a degree of acknowledgement that especially for Gotham, the system just does not work.

But it doesn't matter over all because yeah, comic writing and never letting characters just go so you can keep using them forever. There's really no real way the Joker is alive, even without Batman around the entire city should be trying to kill him on site. Everyone. Anyone who's ever lost family to one of his schemes, any cop who sees him break out for the 5th time to hurt more people, and even the criminal underworld because they get fucked up just as bad as anyone else when he decides to gas the city or poison the water.
