Insanity actually has very little to do with competence to be executed. Ted Bundy, John Wayne Gacy, and the plaintiff in Clark v. Arizona were all executed despite being found insane, and the only reason Charlie Manson isn't already dead is because of a technicality. There's a lot of factors that go into a death sentence, but for someone like the Joker, who clearly understands what he's doing and repeatedly demonstrates intent, there's next to no chance he WOULDN'T be sentenced to death in a real world court if the prosecutors sought it.

Joker had fitted himself with a pacemaker connected to a wireless trigger with powerful bombs randomly hidden around the city as a final joke.
Batman, realizing he was unable to find the bombs in time (their location was hidden ages ago removing any tracks and leads and were completely random spots) was forced to prevent the Joker's death until they removed the pacemaker.
Why he wasn't killed AFTER that story is the same reason why his deaths are never permanent; he's too famous.
Seriously, Batman could viciously butcher the Joker on-page and separate his body into parts and have Solomon Grundy eat them and shit them out into boxes and then have Superman fly them into the fucking sun and The Joker would STILL eventually come back, no matter how contrived the explanation.
Batman could kill the Joker over and over every single issue and he would still come back eventually and Batman would look even MORE stupid and ineffectual because he somehow can't successfully kill a skinny unpowered clown with no skills or abilities to speak of even though he's a well-armed trained physical paragon, even when he DOES kill him.
If you want the Joker to permanently die you need to go back in time and make irrelevant seventy years ago.

That said, The Joker doesn't qualify for the criminal insanity defense. None of Batman's villains (with perhaps the exception of Two-Face) actually do.
Most DC supervillain aren't mass-murders and tend to just commit regular crimes but flashier so they just end up going to prisons specially designed to hold them.
