It's hard to peg where he is, especially since DC doesn't exactly follow realistic psychology for its characters, but I like to think that Batman has a better reason than pure guilt for not killing the Joker.
Of course, another way to think about it is that Batman's failure is really in not giving Arkham much better security, if anything, since the failures with the Joker are mostly institutional. Then again, the Joker could just have some kind of charmed life that enables him to escape all the time... but then it'd probably block attempts at killing him too, and then we're right back where we started.

That would make a more interesting story, to see the Joker face karma and actually die in different ways, depending on the run/writer. How is him just killing people senselessly but not dying and getting away scott free because Plot any better as far as stories go?
