They're both at fault, but neither of them is strictly wrong. Penny made her choice despite being dissuaded the first time - that's enough to make her culpable - and Bojack went against his moral obligation not to fuck the family up. It's the sort of thing that if it happens should remain a shameful secret, like a drunken hookup with a girl/boy who's on a break with their boyfriend/girlfriend who's your friend.

He's a manchild. I can understand letting kids have a drink or two on prom night (fuck, I've did a shot with my son's friends), but there's a huge difference between letting teenagers have a little fun and encouraging potentially dangerous behaviour. The line is sometimes blurry, but it is absolutely clear here.

Futhermore, you should never have sex with someone that much younger than you or someone you have a position of authority over (Bojack was an adult living in her home who had a close relationship with her parents). People arguing about fucking legal status are missing the point.

Penny wanted to be treated like an adult, but she wasn't one. She was smart, and growing up, but she wasn't an adult.

I get the authority thing, but I'm honestly not much different mentally to how I was a decade ago. Legally, if its ok the biggest issue here is how icky the situation is socially, which is a matter to be sorted out by the people affected by it. It's not every adult's responsibility to be every young adult's parents. That's the actual parents job. They fucked up not kicking bojack to the curb, letting him take her to prom, etc. They're supposed to circumscribe everything she does, bracing her for the decisions she's going to have to make in a year or two, with basically the same character as she has now. Most of her character will be formed when she either rejects/accepts this preparation. The truth is you don't start making adult decisions as an adult: you have to enter the world of adulthood first to understand consequences. That's why the friend who lives in mom's garage isn't really an adult: they've never been responsible for themselves. That's why fathers are often much more mature than bachelors.

There's nothing wrong with Bojack or anybody else fucking 16 - 18 year olds if they're not coercing them. Penny came on to Bojack, was rejected, came on again. It's not pretty, but there's clear consent there. He's not wielding his authority, there's no or else, or any suggestion that this is what's best for her. Bojack approaches her as something like senior in the college she's going to, not as an adult man. The problem was that he's betraying the family he was becoming a part of. It's really sad that Bojack is so stunted that at his age he can approach her as an equal.

It was literally agreed to by Charlotte's permission in same episode. Clearly, her later reaction to his potential exploitation of her daughter makes it impossible that she thought Bojack, a 50-something, was being given permission to date her daughter, a 17 year old.

Bojack encouraged three teenagers to drink, to trespass, and to conceal his involvement in their crimes. He supplied alcohol to them. He knowingly deposited an unconscious, intoxicated and incapable minor at a hospital along with another minor, whom Bojack intimidated into concealing Bojack's part in their crimes. This demonstrates a clear understanding not only of his crimes to that point of the evening, but that the penalties for those crimes would be serious and that he was therefore attempting to avoid said penalties. It's as clear a sign of guilt as any jury would need to convict.
